HomeMy WebLinkAboutCity Council Resolution 2011-343CITY OF PLYMOUTH RESOLUTION No. 2011-343 A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR PULTE GROUP - MINNESOTA DIVISION FOR "THE WILLOWS THIRD ADDITION" FOR PROPERTY LOCATED AT 5835 JUNEAU LANE (2011066) WHEREAS, Pulte Group — Minnesota Division has requested approval of a preliminary and final plat for the roughly 1.5 -acre parcel presently legally described as follows: Lot 1, Block 3, THE WILLOWS, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pulte Group — Minnesota Division for preliminary and final plat for The Willows Third Addition, subject to the following conditions: 1. A preliminary and final plat is approved to allow the property located at 5835 Juneau Lane to be subdivided into two single-family lots, in accordance with the application and plans received by the city on August 12, 2011, except as may be amended by this resolution. 2. The review and approval of the standard subdivision requirements for sidewalks are waived with this request and shall be reviewed and considered at the time Juneau Lane is reconstructed. 3. Prior to recording the final plat, the applicant shall pay the park dedication cash fee in lieu of land dedication for one lot, in accordance with the ordinance in effect at the time the final plat is recorded. 4. Prior to recording the final plat, the applicant shall remove the accessory strictures from Lot 2. 5. Prior to recording the final plat, the following revisions shall be made to the plat consistent with city code, the zoning and subdivision ordinances, and the engineering guidelines: a. Revise the tree preservation plan to note the following trees would be disturbed based on the improvements shown on the plans: 956, 957, 958, 959, 960, 919, 634, 635, 636, 646, 923 and 925. b. Indicate the intersection of 59"' Avenue and Juneau Lane as a "T". Res. 2011-343 File 2011066 Page 2 c. Note that the future driveway may require a culvert if Juneau Lane is still a rural section at the time of constriction. d. Identify document numbers on all existing easements. e. Execute a private utility easement to allow the utility services for Lot 2 to cross Lot 1. 6. Prior to the issuance of a building permit, the applicant shall submit a survey indicating that a minimum of two front yard trees shall be preserved or that two new trees will be planted. 7. Standard Conditions: a. No building permits shall be issued until the final plat and easements are filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. This approval shall expire two years after the date of approval, unless the property owner or applicant recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
