RESOLUTION NO. 2000-008
AMENDING DEVELOPMENT CONTRACT
SILVERTHORNE 4TH ADDITION (97133)
WHEREAS, It is necessary to amend the Development Contract for Silverthorne 4th Addition
because certain lots and street right of way will be included in the final plat for Providence
Academy a private school.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: that it should and hereby does approve amending the
Development Contract for Silverthorne 4th Additon as follows and authorizing the Mayor and City
Manager to sign the amended contracts:
Item 2.1 -a -Residential Streets, 51st Avenue east of Quantico Lane and Polaris Lane shall be
deleted
Item 14.10 shall be deleted and replaced with the following: "Private driveway access shall be
limited to internal public roads and restricted from Schmidt Lake Road for Outlot F."
Item 14.13 shall be deleted and replaced with the following: "The developer shall construct an
eight -foot wide trail along the north side of Schmidt Lake Road, as required by Condition 5 of
Resolution No. 97-707. For this first phase, the developer shall install the trail from the west line
of Outlot F to the west curb line of Quantico Lane prior to issuance of building permits. Notice
of the trail and corresponding 10 -foot wide easement shall be included in the development/sales
documents so that potential buyers will be aware of the trail."
Item 14.14 shall be deleted from the contract which states: The Final Plat submission shall
include a 25 -foot wide trail easement in the area of the existing power line easement. This trail
easement shall be centered on the north/south lot lines running through this area. Notice of the
trail easement shall be included in the development/sales documents so that potential buyers will
be aware of the possible future trail for this location.
