HomeMy WebLinkAboutCity Council Resolution 2000-005CITY OF PLYMOUTH RESOLUTION 2000-005 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR PROVIDENCE ACADEMY FOR "PROVIDENCE ACADEMY ADDITION", LOCATED NORTH OF SCHMIDT LAKE ROAD BETWEEN QUANTICO LANE NORTH AND MINNESOTA LANE NORTH (99088-F) WHEREAS, Providence Academy has requested approval of a final plat to create one lot on roughly 41 acres located north of Schmidt Lake Road between Quantico Lane North and Minnesota Lane North; and WHEREAS, the property is legally described as follows; Lots 3, 4, 5, 6, and 7, Block 3, Lots 1-14, Block 4, Silverthorne 4th Addition, Polaris Avenue North, vacated, as dedicated in said Silverthorne 4th Addition, and that part of 51st Avenue North, vacated, as dedicated in said Silverthorne 4th Addition lying easterly of the northeasterly extension of the northwesterly line of Lot 4, said Block 4, all according to the recorded plat thereof and situate in Hennepin County, Minnesota. and Outlot A, Silverthorne 5th Addition, according to the recorded plat thereof and situate in Hennepin County, Minnesota. That part of the northwest quarter of the southeast quarter, and the southwest quarter of the northeast quarter, all in Section 9 Township 118 North, Range 22 West of the Fifth Principle Meridian lying north of the north line of the south 22.74 acres of said northwest quarter of the southeast quarter, east of the east line of Silverthorne, according to the recorded plat thereof, Hennepin County, Minnesota, and south of the south right-of-way of the Soo Line Railroad. EXCEPT the south 200.00 feet as measured along the east and west lines thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. Resolution 2000-005 (99088-F) Page 2 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Providence Academy Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: This final plat approves one lot and two outlots in accordance with the plans received by the City on December 1, 1999, except as amended by this Resolution. 2. Payment of park dedication fees -in -lieu of dedication, in accordance with the Dedication Policy in effect at the time of issuance of the building permit. The developer may choose to negotiate with the Park and Recreation Director for a reduction in the fee, based on public use of their athletic fields. 3. A trail easement shall be provided along the western boundary of the property adjacent to Quantico Lane North. A ten -foot wide trail built to City specifications shall be constructed by the developer behind the curb. The City shall reimburse the developer for the cost of paving this trail. Grading and suitable ground cover are the responsibility of the developer. 4. A trail built to City specifications shall be constructed by the developer along the north side of Schmidt Lake Road between Minnesota Lane and Quantico Lane. The developer shall be responsible for the total cost of this trail. If the right -of way is of adequate width to include the trail and maintain at least a four -foot wide grassy boulevard between the curb and the trail, the trail shall be eight feet wide. If the right -of way is not of adequate width to include the trail and maintain at least a four -foot wide grassy boulevard between the curb and the trail, the trail shall be ten feet wide and shall be constructed directly behind the curb. 5. Compliance with the City's Tree Preservation Ordinance. 6. Prior to issuance of a grading permit, the applicant shall demonstrate compliance with all erosion control ordinances and policies, as well as the approved tree preservation plan. 7. Prior to issuance of building permits, wetland buffer monuments shall be located adjacent to the off-site wetland in accordance with Section 21670.07 of the Zoning Ordinance. The monument design shall be approved by the Community Development Department. 8. Submission of the required Financial Guarantee and Site Performance prior to issuance of building permits. The Site Improvement Performance Agreement shall include, but not be limited to, the required wetland buffer monumentation. Resolution 2000-005 (99088-F) Page 3 9. The signing of the plat by the City as owner is conditioned on the City Attorney approving the endorsement for title insurance on the City parcel. 10. The City consents to the assignment of the real estate purchase agreement between Laurent Land Development and the City for the city -owned parcel within the plat to Providence Academy, a Minnesota non-profit corporation. 11. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. D. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. E. A pond maintenance agreement is required between the developer and the City for the water quality ponds. ADOPTED by the City Council on January 4, 2000. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
