RESOLUTION No. 2011-293
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR OPPIDAN, INC. FOR
"CROSSROADS COMMONS" FOR PROPERTY LOCATED SOUTH OF HIGHWAY 55,
BETWEEN COTTONWOOD LANE AND COUNTY ROAD 73 (201 1014)
WHEREAS, Oppidan, Inc. has requested approval of a preliminary plat for the roughly
19 -acre site presently legally described as follows:
Parcel A:
Tracts A and B, Registered Land Survey No. 1676, Hennepin County, Minnesota.
Parcel B:
That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118, Range
22, Hennepin County, Minnesota, described as follows:
Commencing at the Southwest corner of the Southeast Quarter of the Northeast Quarter, Section
35, Township 118, Range 22; thence North along the West line thereof 805 feet; thence East
parallel with the South line of said quarter -quarter 683.20 feet to the point of beginning; thence
continuing East along said parallel line 100 feet; thence Northeasterly, deflecting to the left 81
degrees 49 minutes a distance of 108.3 feet, more or less to the Southerly right-of-way line of
State Think Highway No. 55; thence Northwesterly along the Southerly right-of-way line of said
Highway 97.99 feet; thence Southwesterly 136.74 feet, more or less, to the point of beginning.
Parcel C:
That part of the Southwest Quarter of the Northwest Quarter of Section 36,Township 118, Range
22, Hennepin County, Minnesota, lying Southwesterly of the Southwesterly line of Old County
Road 6 and described as beginning at the intersection of the West line of said Section 36 with the
Southwesterly line of Old County Road 6; thence Southerly along the West line of said Section
36, a distance of 313.50 feet; thence Northeasterly to a point on the Southwesterly line of Old
County Road No. 6, distant 173.10 feet Southeasterly of the point of beginning; thence
Northwesterly along the Southwesterly line of Old County Road No. 6, a distance of 173.10 feet
to the point of beginning. Together with that part of vacated Old County Road No. 6 right-of-
way lying southerly of the centerline of said vacated Old County Road No. 6, located in that part
of the Southwest Quarter of the Northwest Quarter of Section 36, Township 118, Range 22,
Hennepin County, Minnesota lying Northwesterly of the Southwesterly extension of the
Northwesterly line of Naumann Cartway (as referenced on the plat of SCHIEBE' S HIGHLAND
VIEW ADDITION).

That part of the Southwest Quarter of the Northwest Quarter of Section 36, Township 118,
Range 22, Hennepin County, Minnesota, lying Southwesterly of the Southwesterly line of Old
County Road No. 6, and described as commencing at the Southwest corner of the Northwest
Quarter of said Section 36; thence Northerly along the West line of said Section 36, a distance of
210.30 feet to the point of beginning; thence deflect to the right at an angle of 90 degrees 30
minutes, a distance of 9.00 feet; thence Northeasterly 358.30 feet to a point on the Southwesterly
line of Old County Road No. 6, distant 248.10 feet Southeasterly of the intersection of said
Southwesterly line with the West line of said Section 36; thence Northwesterly along the
Southwesterly line of Old County Road No. 6, a distance of 75.00 feet; thence Southwesterly to a

22, Hennepin County, Minnesota; lying Southerly of the centerline of the Eastbound lane of
State Think Highway No. 55 (as now located and established); and lying Southwesterly of the
Northeasterly line of Old County Road No. 6 (also being the Northeasterly line of Tract B,
Registered Land Survey No. 1676) and the Northwesterly extension thereof, and lying Northerly
of the Northeasterly lines of Tracts A and B, Registered Land Survey No. 1676; and lying
Northerly of a line beginning at the Northwest corner of Tract B, Registered Land Survey No.
1676; thence North 74 degrees 06 minutes 45 seconds West on an assumed bearing along the
Northwesterly extension of the North line of said Tract B, a distance of 97.99 feet; thence South
8 degrees 54 minutes 02 seconds West, a distance of 15.11 feet to the Northeast corner of Tract
A, Registered Lane Survey No. 1676, and there terminating; and lying Southeasterly of a line
drawn Northeasterly from the Northwest corner of Tract A, Registered Land Survey No. 1676, at
a right angle to the North line of said Tract A, a distance of 75.00 feet to the centerline of the
Eastbound lane of State Think Highway No. 55 (as now located and established), which lies
Southwesterly of a line run parallel with and distant 70.00 feet Southwesterly (as measured at
right angles) of the following described line:
Beginning at a point of the West line of the Northeast Quarter of said Section 35, distant
1065.36 feet South of the Northwest corner thereof, thence run Southeasterly at an angle of
73 degrees 22 minutes 02 seconds from said West line of the Northeast Quarter (measured
from South to East) for 2608.47 feet to a tangent spiral point; thence deflect to the right on
a spiral curve of decreasing radius (spiral angle 2 degrees 00 minutes 00 seconds) for 200
feet to a spiral curve point; thence deflect to the right on a 2 degrees 00 minutes 00 seconds
circular curve (delta angle 11 degrees 34 minutes 00 seconds) for 578.33 feet to a curve
spiral and there terminating.

Parcel F
That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118, Range
22, lying Southerly of the Southerly right-of-way line of State Trunk Highway No. 55 and
Northeasterly of the Northeasterly line of Old County Road No. 6, now being referred to as a
frontage or service road to State Trunk Highway No. 55.

All that part of the Southwest Quarter of the Northwest Quarter of Section 36, Township 118
North, Range 22 West of the 5th Principal Meridian, lying Northeasterly of County Road 6,
Northwesterly of Naumann Avenue, and lying Southwesterly of Trunk Highway No. 55.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request
by Oppidan, Inc. for a preliminary plat for Crossroads Commons PUD, subject to the following
conditions:
I. A preliminary plat is approved to establish two lots (one for senior housing and one for a
fast food restaurant) and three outlots (one for water quality, one for fi ture commercial
development, and one set aside for possible County Road 73 re -alignment in the fi ture), in
accordance with the plat and plans received by the city on June 21, 2011, except as may be
amended by this resolution.
2. Approval of the preliminary plat is contingent upon City Council approval of the reguiding
of the site to MXD (mixed use).
3. Prior to issuance of a grading permit or any grading activities, the applicant shall install
and request inspection of silt fencing and tree preservation fencing.
4. Prior to final platting, the applicant shall fulfill the requirements, submit the required
information, and revise the plans as indicated below, consistent with the applicable city
code, zoning ordinance, and engineering guidelines:
a. Right-of-way/ easement/ agreement/ permit requirements:
(1) Verify that vacation of a portion of Highway 55 right-of-way will be approved by
Mn/DOT.
(2) Separate unobstructed maintenance access easements are required for sanitary
sewer and storm sewer manholes outside street right of way. The access

easements must be 15 feet wide and must have a slope of less than ten percent
with a 12 foot wide driving surface capable of supporting maintenance equipment.
(3) Drainage and utility easements are required over the storm water vaults, storm
water basins A, B and C, wetlands, and ponds.
(4) A 40 -foot by 36 -foot street and snow storage easement is required for the
hammerhead turnaround at the end of Cottonwood Lane.
(5) A 5 -foot wide sidewalk easement is required along the south side of the frontage
road.
(6) Encroachment agreements are required where retaining walls are located in
drainage and utility easements.
(7) Maintenance agreements are required for the storm water vaults and infiltration
basins.
(8) The applicant shall obtain the necessary permits and approvals as follows:
MPCA, Minnesota Department of Health, Bassett Creek Watershed Organization,
NPDES, DNR, Hennepin County, Mn/DOT, and City of Plymouth.
b. Grading and erosion control plans:
(1) Move the retaining wall on Lot 1, Block 1, out of the existing drainage and
utility easement.
(2) A fence will be required on top of all retaining walls over 4 feet in height.
(3) Indicate emergency overflow (EOF) elevations for the ponds, streets, and
wetlands.
(4) Eliminate the existing entrance to Highway 55 between West Medicine Lake
Drive and County Road 73.
(5) Indicate locations of rock constriction entrances.
(6) Call out inlet protection for all catch basins on the erosion control plan.
(7) Eliminate gravel driveway to northwest corner of the site from Cottonwood
Lane.
c. Street and utility plans:
(1) Add street names on all plan sheets.
(2) Provide plan and profile for storm sewer.
(3) Change storm sewer manhole castings from R-1733 to R -1642-B.
(4) Reconstruct storm sewer manhole B. Confirm storm sewer manhole B is large
enough to support an additional 24 -inch connection.
(5) Consider eliminating storm sewer manhole 3 and extending storm sewer to catch
basin 2A.
(6) Extend pipe from existing catch basin manhole A to existing 88 -inch RCP
(reinforced concrete pipe) arch pipe and eliminate the ditch between Highway 55
and the frontage road.
(7) Furnish additional information on how access will be provided to storm water
vaults.

(8) Confirm that proposed geometrics for West Medicine Lake Drive line up with
existing geometrics on the north side of Highway 55.
(9) Confirm the westbound left turn movement on Highway 55 at West Medicine
Lake Drive can be made without modifying the existing median.
(10) Confirm the eastbound left turn movement from the frontage road to West
Medicine Lake Drive functions as shown. Consider extending pavement
markings to improve turning movement.
(11) Provide a raised concrete median on West Medicine Lake Drive.
(12) Show a typical street section for streets and for County Road 73. A 9 -ton design
is required.
(13) Minimum street grades shall be 0.75 percent.
(14) Provide a 5 -foot wide boulevard between the sidewalk and curb on the frontage
road.
(15) All curb and gutter in public right-of-way shall be Type B618.
(16) Extend 12 -inch water main in frontage road from the most westerly connection
point to the most easterly connection point. Abandon the existing water main
along Highway 55 between the two connection points.
(17) Provide a plan and profile for water main and sanitary sewer.
(18) Provide a constriction staging plan for keeping the frontage road west of West
Medicine Lake Drive open to traffic at all times.
(19) Provide more detail for relocation of existing traffic signal poles.
(20) Provide advisory signage for the 15 mile per hour curve on the east end of the
frontage road.
d. Water resource plan:
(1) A storm water pollution prevention plan (SWPPP) needs to be added to
plans along with responsible parties and contact information.
(2) Indicate correct wetland buffers and setbacks adjacent to wetland areas
shown.
e. Fire plan:
(1) Submit turning radius evaluations.
(2) Fire lane signs are required in approved locations in the areas without
designated parking, and at the hammerhead turnaround at the end of
Cottonwood Lane.
(3) Submit fire flow calculations for the entire development.
(4) Secure an administrative variance relating to fire lanes for the senior
housing building.
(5) The fire department connection must be located in an approved location at
the main entry door area.
(6) Relocate hydrants to approved locations, as designated by the fire
inspector.

(7) The minimum required vertical clearance of the main entry canopy for the
senior housing building is 13.5 feet.
5. The required traffic improvements shall be completed prior to occupancy of the senior
housing building and/or businesses within the PUD.
6. The sidewalks and trails along the streets shall be installed when the streets are installed.
7. Individual sites within the development shall provide their own storm water treatment and
volume reduction. Detailed drainage plans shall be required with the PUD final plan
application for each site.
8. Wetland buffer strips and related the stricture setback shall be provided, in accordance with
city requirements.
9. Standard conditions:
a. No building permits shall be issued until the final plat is recorded with Hennepin County
and proof of recording is submitted to the city.
b. No building permits shall be issued until the development contract is executed and the
financial sureties required by it are provided to the city.
c. The required park dedication fee, based upon the upland acreage, shall be paid with the
building permit for each lot. This fee shall be calculated in accordance with the park
dedication ordinance in effect at the time of building permit issuance.
d. Building permits are required for retaining walls 48 inches in height or higher.
e. Compliance with the city's tree preservation regulations.
f. This approval shall expire one year after the date of approval, unless the property owner
or applicant has recorded a final plat, or unless the landowner or applicant has received
prior approval from the city to extend the expiration date for up to one additional year, as
regulated under section 510 of city code.
