RESOLUTION No. 2011-289
A RESOLUTION AUTHORIZING THE VACATION OF CERTAIN STORM DRAINAGE, TURN-
AROUND AND ROADWAY EASEMENTS WITHIN THE WEST HALF
OF THE NORTHWEST QUARTER OF SECTION 8-118-22,
WHEREAS, a public hearing with respect to said vacations was scheduled for August 23,
2011, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of August 23, 2011; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the City Council did hold a public hearing on August 23, 2011 to inform any
and all interested parties relevant to the vacation of all storm drainage, turn -around and roadway
easements lying west of the east line of the south 2018.6 feet of the west 672.00 feet of the west half
of the Northwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota; and
WHEREAS, it was determined by the City Council that said easements are not needed for
public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That said storm drainage, turn -around and roadway
easements lying west of the east line of the south 2018.6 feet of the west 672.00 feet of the west half
of the Northwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota; be
vacated:
FURTHER, that said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and
storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to
continue maintaining the same or to enter upon such way or portion thereof vacated to maintain,
repair, replace, remove, or otherwise attend thereof.
FURTHER, that this resolution shall be recorded prior to but concurrent with the recording
of the final plat for Elm Creek Highlands East.
