HomeMy WebLinkAboutCity Council Resolution 2011-278CITY OF PLYMOUTH RESOLUTION NO. 2011-278 A RESOLUTION AMENDING RESOLUTION NO. 2011-245 THAT APPROVED A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "ELM CREEK HIGHLANDS EAST" FOR PROPERTY LOCATED NORTH OF SCHMIDT LAKE ROAD (2010048-F) WHEREAS, Pulte Homes requested approval of a final plat and development contract for 37 single-family lots within the southerly portion of "Elm Creek Highlands East' and three outlots on roughly 31 acres of land located north of Schmidt Lake Road in the vicinity of Jewel Lane; and WHEREAS, on July 26, 2011, the City of Plymouth approved said final plat and development contract, per City Resolution No. 2011-245; and WHEREAS, the property is presently legally described as follows: Lots 1-3, Block 1, Lots 1-24, Block 2, Lots 1-10, Block 3, and Outlots A, B, and C, Elm Creek Highlands East, Hennepin County, MN; and WHEREAS, the City of Plymouth desires to amend Resolution No. 2011-245 and said development contract; and WHEREAS, City Staff has prepared an amendment to paragraphs 20, 21, 27, and 31 of said development contract; and WHEREAS, Pulte Homes has agreed to the amended resolution and has executed the amendment to said development contract. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve amending City Resolution No. 2011-245 pertaining to a final plat and development contract for Elm Creek Highlands East; and FURTHER, that it should and hereby does approve the request by the City of Plymouth to amend the development contract for Elm Creek Highlands East and the Mayor and City Manager be authorized to execute the amendment on behalf of the City; and, FURTHER, that the following amended conditions be met prior to recording of, and related to said plat: Resolution No. 2011-278 Page 2 of 2 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: b. Assessments/easements/agreements/permit requirements: (1) Water main area charges: Based on 14.95 acres — 0.21 acres wetland = 14.74 acres. $3,659 per acre x 14.74 = $53,933.66 (2) Sanitary sewer area charges: Based on 14.95 acres — 0.21 acres wetland = 14.74 acres. $986 per acre x 14.74 = $14,533.64 (7) Submit the deed for outlots A and B. FURTHER, that City staff record the amendment to the development contract with Hennepin County. Adopted by the Plymouth City Council on August 23, 2011. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
