HomeMy WebLinkAboutCity Council Resolution 2015-301 CP ITY OF LYMOUTH RN.2015-301 ESOLUTION O RACUP,SPA, ESOLUTION PPROVING A ONDITIONAL SE ERMIT ITE LAN MENDMENT AND VERP,I.AOUE50 ARIANCE FOR AGLE IDGE ARTNERS NC TO LLOW FFICE SES IN XCESS OF PRSI2800VL(2015078) ERCENT AND ELATED ITE MPROVEMENTS AT ICKSBURG ANE WHEREAS, Eagle Ridge Partners, Inc. has requested approval of a conditional use permit, site plan amendment, and variance to allow office uses in excess of 50 percent in an existing building and related site improvements at 2800 Vicksburg Lane, legally described as Lots 1 and 2, Block 1, Vicksburg Industrial Park, Hennepin County, Minnesota; and, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Eagle Ridge Partners, Inc. for a conditional use permit, site plan amendment, and variance, subject to the following conditions: 1.A conditional use permit is approved to allow 60 percent office use in the existing building, with the finding that all applicable conditional use permit standards would be met, in accordance with the plans received by the city on August 28 and September 11, 2015, except as amended by this resolution. 2.A site plan amendment is approved to allow a parking lot expansion and related site improvements, in accordance with the plans received by the city on August 28 and September 11, 2015, except as amended by this resolution. 3.A variance is approved to allow a parking setback of 16.75 feet from the property line where 50 feet is required, with the finding that all applicable variance standards would be met, in accordance with the plans received by the city on August 28 and September 11, 2015, except as amended by this resolution. 4.A separate building permit is required prior to commencement of the project. 5.Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a.Complete a site improvement performance agreement and submit the related financial guarantee and fees pursuant to section 21045.10 of the zoning ordinance. b.Obtain city approval of final construction plans. c.Revise the landscaping plan to add four overstory trees to the plan. d.Submit cut-sheets for all fixtures listed on the lighting plan and include the CRI, CCT and BUG information for each fixture. Resolution 2015-301 File 2015078 Page 2 e.Revise the plans to indicate a conforming parking space width for the angled parking and a conforming length for the parallel spaces. f.Revise the plans to indicate that the east side of the building would be painted to match the west. g.Revise the plans to provide a 10-foot setback between the building and the new parking spaces proposed in the loading area and a 26-foot drive-aisle between the new parking space rows. h.Revise the plans to indicate fire lane signs in approved locations and add a detail to the plans. i.Revise the fire apparatus exhibit to indicate turning radii for both the west drive aisle and the new parking area on the east side of the property to remove any conflicts between the trucks and curbs or parking spaces. 6.Standard Conditions: a.Trash and recycling containers shall be stored consistent with the requirements of section 21120.02 of the zoning ordinance. b.Separate building permits are required for retaining walls 48 inches in height or higher. c.Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. d.The conditional use permit, site plan amendment, and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21015.07, 21045.09, and 21030.06 of the zoning ordinance, respectively.
