HomeMy WebLinkAboutCity Council Resolution 2011-276CITY OF PLYMOUTH RESOLUTION No. 2011-276 A RESOLUTION TO APPROVE ENCROACHMENT AGREEMENT FOR A RETAINING WALL WITHIN A DRAINAGE AND UTILITY EASEMENT IN LOT 4, BLOCK 1, PALMER CREEK ESTATES 4TH ADDITION AT 5135 IVES LANE WHEREAS, property owners Dustin and Coventry Snare requested the City to approve an encroachment agreement allowing a retaining wall to be constricted within a drainage and utility easement at 513 5 Ives Lane; and WHEREAS, the encroachment agreement permits only the retaining wall within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the owners property is legally described as Lot 4, Block 1, Palmer Creek Estates 4t1' Addition. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth, the encroachment agreement that will allow the retaining wall in a drainage and utility easement.
