HomeMy WebLinkAboutCity Council Resolution 2011-264CITY OF PLYMOUTH RESOLUTION No. 2011-264 A RESOLUTION DENYING A PETITION REQUESTING PREPARATION OF AN ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) FOR "CROSSROADS COMMONS" -A PROPOSED REDEVELOPMENT OF THE FORMER PLYMOUTH SHOPPING CENTER SITE LOCATED SOUTH OF HIGHWAY 55 BETWEEN COTTONWOOD LANE AND COUNTY ROAD 73 (201 1060) WHEREAS, Oppidan, Inc. has requested approval of redevelopment plans that include a reguiding, preliminary plat, and PUD amendment for the roughly 19 -acre site located south of Highway 55 between Cottonwood Lane and County Road 73; and WHEREAS, the Minnesota Environmental Quality Board (EQB) received a citizens petition for an environmental assessment worksheet (EAW) for the proposed Crossroads Commons redevelopment project; and WHEREAS, the petition for the EAW included three primary concerns including trees and wildlife habitat, the wooded area, and storm water runoff, and WHEREAS, the Minnesota Environmental Review Program Rules provide for the mandatory preparation of an EAW for those projects that meet or exceed the thresholds contained in the Section 4410.4300 of the Rules; and WHEREAS, the Minnesota Environmental Review Program Rules provide for the discretionary preparation of an EAW for those projects where the City Council, acting as the responsible governmental unit, (RGU) finds that because of the nature or location of the proposed project, the project may have the potential for significant environmental effects. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby determines than an EAW shall not be required for the proposed Crossroads Commons redevelopment project (city file 2011014), based on the following findings: a) The petition fails to demonstrate that, because of the nature or location of the proposed project, the project may have the potential for significant environmental effects. b) The project proposer has either addressed all environmental concerns indicated in the petition for the EAW, or the city would address them through code requirements and conditions if the project is ultimately approved, therefore, the project would not result in significant environmental effects. c) Storm water runoff would be addressed through the established development review and approval process.
