HomeMy WebLinkAboutCity Council Resolution 2011-259CITY OF PLYMOUTH RESOLUTION No. 2011-259 A RESOLUTION AUTHORIZING AN AGREEMENT WITH THREE RIVERS PARK DISTRICT (2011058) WHEREAS, Three Rivers Park District and the City of Plymouth have prepared an agreement relating to Trillium Woods to allow the constriction of the extension of Cheshire Parkway, the Medicine Lake regional trail, the Northwest Greenway trail corridor and related improvements onto land owned by the park district; and, WHEREAS, the Three Rivers Park District has approved and authorized the Chair of the Three Rivers Board of Commissioners and the Superintendent to execute an agreement at its August 4, 2011 meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: The attached agreement is hereby approved, and the mayor and city manager are authorized to execute an agreement on behalf of the City of Plymouth based on the following tenets: 1. The park district has agreed to convey property to the city as shown on the attached exhibit. 2. The park district will provide the city with an easement to allow constriction of a corner of the Northwest Greenway trailhead parking lot and a small portion of Cheshire Parkway over another property owned by the park district. 3. If the Trillium Woods developer proceeds with the project and the trail is completed, the city will provide the park district with a trail easement for the as -built trail corridor. If the developer does not proceed with constriction of the project or the trail is not completed by December 31, 2012, the city will return the land and easements to the park district. 4. The parties will continue to negotiate other outstanding issues regarding regional trail easements and Glacier Vista compensation from a 2002 land exchange agreement and fiiture cooperative matters. 5. If requested by the city, the park district will issue an encroachment permit to the Trillium Woods developer or its contractor to commence grading for the extension of Cheshire Parkway.
