HomeMy WebLinkAboutCity Council Resolution 2011-258CITY OF PLYMOUTH RESOLUTION No. 2011-258 A RESOLUTION APPROVING A PUD GENERAL PLAN FOR CORNERSTONE AUTO RESOURCE FOR "CORNERSTONE AUTO PUD" FOR PROPERTY LOCATED IN THE SOUTHEAST QUADRANT OF COUNTY ROAD 9 AND 1-494 (2011037) WHEREAS, Cornerstone Auto Resource has requested approval of a PUD (planned unit development) general plan for the roughly 5.6 -acre site presently legally described as follows: Lot 1, Block 1, Powells Addition, Hennepin County, Minnesota; n Lot 1, Block 1, Amoco Oil Company 2" a Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Cornerstone Auto Resource for a PUD general plan for Cornerstone Auto PUD, subject to the following conditions: 1. A PUD general plan is approved for "Cornerstone Auto PUD," in accordance with the application and plans received by the city on June 8, 2011, except as may be amended by this resolution. 2. Approval of the PUD general plan is contingent upon rezoning of the site from C-4 (community commercial) to PUD (planned unit development). 3. Prior to commencement of the project and issuance of the required grading permit, the applicant shall apply for, and receive city staff approval of, a PUD final plan. 4. Prior to commencement of the project and issuance of the required grading permit, the applicant shall combine the two existing parcels into one parcel. 5. Development standards for the PUD shall be as indicated on the plans received by the City on June 8, 2011, except as may be amended by this resolution. 6. The uses allowed in the PUD shall include all permitted, accessory, conditional, interim, and administrative uses in the C-4 (community commercial) district, together with an automobile dealership. The PUD final plan shall include a final lighting plan that complies with the city's lighting regulations, including the requirement that lighting fixtures located within 300 feet of residential property shall be equipped with house -side shielding. 8. Prior to issuance of the required PUD final plan, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Dedication/ easement/ permit requirements: (1) Provide an easement for additional right-of-way along County Road 9, pursuant to the request from Hennepin County. (2) Re-establish a 20 -foot wide drainage and utility easement along the west property line, to be centered over the top of the existing watermain. (3) Verify that encroachment of the parking lot and pylon sign within Great River Energy's private easement is acceptable to the easement owner. (4) Prior to any installation of utilities or constriction, obtain the necessary, applicable permits and approvals as follows: Bassett Creek Watershed Management Organization, NPDES, Hennepin County, and City of Plymouth. b. Grading and erosion control plans: (1) Refer to current City of Plymouth Standard Details in all detail notes. (2) Protect the two existing catch basins on Vinewood Lane in the vicinity of proposed curb constriction. (3) Protect the existing catch basin located on the southwest curb line of the existing parking lot and recess the proposed curb to allow drainage to enter the stricture. (4) Provide inlet protection for catch basins in Vinewood Lane and for existing catch basins to remain in the parking lot. (5) Identify utility lines that are to be removed on the demolition plan. (6) Provide wood fiber blanket on all 3:1 slopes. (7) Show concrete trick washout station location. (8) Keep pylon sign poles a minimum of 15 feet from the existing watermain. c. Utility plans: (1) Connection to the existing catch basin on Vinewood Lane shall be made by core drilling. (2) Reconstruct the existing catch basin on Vinewood Lane south of the proposed driveway entrance with new frame and casting. (3) Add a catch basin along the north curb line at curb elevation 965.8 and connect to the existing storm sewer manhole located approximately 110 feet to the south. Resolution 2011-258 File 2011037 Page 3 (4) Add a catch basin on the north side of the new driveway entrance and connect to the proposed new catch basin to the north. (5) Convert the existing storm sewer manhole in the southeast corner of the proposed parking lot to a catch basin. (6) Add a catch basin over the existing pipe in the southeast corner of the proposed parking lot to eliminate the drainage swale and curb cut. (7) Eliminate the concrete swale along the south curb line of the parking lot and modify the curb alignment to eliminate the low point. (8) Rip Rap material shall be Class 3 granite. (9) Use concrete grout to seal the opening in the catch basin on Vinewood Lane where storm sewer will be removed. (10) All new watermain shall be PVC C900. (11) Install pedestrian ramps on both sides of the new driveway entrance. (12) Extend the bituminous trail along Vinewood Lane through closed driveways. (13) Provide a typical section for bituminous trail constriction. d. Fire protection: (1) Relocate hydrants to approved locations, as identified by the fire inspector. (2) Submit turning radius evaluations on drive aisles as identified by the fire inspector. Apparatus cannot come in contact with any objects, curbs or extend into parking spaces. (3) Fire lane signs are required in approved locations, as identified by the fire inspector. 9. Signage shall comply with the following: a. All signs shall conform with Section 21155.05 (Signs - General Regulations and Restrictions) of the zoning ordinance, except as amended herein. b. The site shall be allowed one free-standing sign near the I-494/County Road 9 intersection that contains up to 100 square feet in area, is up to 36 feet in height, and is set back at least ten feet from lots lines. c. The site shall be allowed one monument -type sign near the Vinewood Lane entrance to the site that contains up to 32 square feet in area, is up to six feet in height, and is set back at least ten feet from lot lines. d. The site shall be allowed wall signage on the north, west, and east elevations of the building, limited to ten percent of the wall area to which the signage is attached. e. Back -lit awnings are prohibited. f. Directional or temporary signage shall comply with zoning ordinance requirements. g. Signage locations and details shall be shown on the site plan and building elevation when the required PUD final plan is submitted, for determination of compliance with the above requirements. Resolution 2011-258 File 2011037 Page 4 10. Compliance with the city's landscaping regulations. In conjunction with submission of the PUD final plan application, the applicant shall provide a revised landscape plan that addresses species, size, and spacing of plantings for prior review and approval by the City Forester. Upon completion of the project, the number of boulevard trees along Vinewood Lane shall remain same as the existing number of boulevard trees along Vinewood Lane. 11. All waste and waste containers shall be stored within the building. Except for inventory vehicles and vehicles awaiting service, there shall be no outside storage of materials or equipment allowed on the site. 12. Service doors shall be closed except when vehicles are entering or exiting the service area. 13. There shall be no exterior voice amplification (e.g., paging system, music) on the site. 14. Standard Conditions: a. Compliance with the ordinance regarding the location of fire hydrants, post indicator valves, fire department connections, fire lanes, and fire lane signage. b. Prior to commencement of the project and issuance of the required grading permit, the applicant shall enter into a site improvement performance agreement and shall provide the required financial guarantee. The agreement shall include, but not be limited to, all landscaping, lighting, and revisions to the lane striping on Vinewood Lane to address the relocated access point. c. An 8 1/2 x 11 inch "as built" fire protection plan shall be submitted prior to the release or reduction of any site improvement surety. ADOPTED on August 9, 2011.
