RESOLUTION No. 2011-255
A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT
FOR "SPRING MEADOWS 2ND ADDITION" FOR PROPERTY LOCATED AT
5550 DUNKIRK LANE (2011019-F)
WHEREAS, O'Donnell Woods, LLC has requested approval of a final plat for 35 new
single-family lots, 2 outlots, and a lot -block designation for an existing home site on the roughly
39 acres of land located at 5550 Dunkirk Lane; and
WHEREAS, the property is presently legally described as follows:
Parcel 1:
The north 677.19 feet of the Southwest Quarter of the Southeast Quarter of Section
5, Township 118, Range 22, except the west 33.00 feet thereof, Hennepin County,
Minnesota.

Parcel 2:
That part of the Southwest Quarter of the Southeast Quarter of Section 5,
Township 118, Range 22, lying south of the north 677.19 feet thereof, except the
west 33.00 feet thereof, Hennepin County, Minnesota.

WHEREAS, city staff has prepared a development contract covering the improvements
related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by O'Donnell Woods, LLC for a final plat for Spring Meadows 2"a Addition;
and
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the mayor and city manager be
authorized to execute the development contract on behalf of the city; and

FURTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. The final plat for Spring Meadows 2"a Addition is approved in accordance with the plans
received by the city on June 16, 2011, except as may be amended by this resolution.
2. Prior to recording the final plat, the applicant shall execute a development contract for the
public and private improvements, and shall submit the required financial guarantees.
3. The park dedication fee in lieu of land dedication shall be paid with final platting, pursuant to
ordinance requirements.
4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
city code, zoning ordinance, and engineering guidelines:
a. Grading/ erosion control plan:
(1) Indicate the high water level (HWL) and normal water level (NWL) for Wetland
C.
(2) Raise lowest floor elevation for Lot 2, Block 1 to 992.9, and raise lowest floor
elevation for Lot 1, Block 1 to at least 992.0.
b. Rights-of-way/ easements/ agreements:
(1) Right-of-way from adjacent parcels is required to extend 54"' Avenue to Comstock
Lane.
(2) Dedicate a drainage and utility easement over all of Outlot C.
(3) Dedicate a street easement over the northeasterly 50 feet of Outlot C.
(4) Provide a drainage and utility easement document in a recordable form for the
south 6 feet of Lot 10, Block 1.
(5) Maintenance agreements are required for filtration shelves.
c. Street and utility plans:
(1) Eliminate the street sign and stop sign for Street 5.
(2) Indicate Archer Lane as a fiiture street in plan and profile.
(3) Move the sump from storm sewer outlet stricture 2 to storm sewer manhole 22.
(4) Tie all pipe joints between storm sewer outlet control strictures and aprons and all
culvert aprons.
(5) Use the current standard detail plates dated March 2011.

5. Prior to issuance of building permits, permanent wetland buffer monument signs must be
installed pursuant to ordinance requirements.
6. The homeowner's association documents shall address: a) responsibilities for maintenance
and repair of wetland buffers, buffer monuments, developer -installed retaining walls, filtration
basins, association common spaces, sidewalks located at the rear of homes, landscaped areas,
and similar features; b) responsibilities for retaining walls that cross or are adjacent to
property lines; and c) prohibition of strictures and clearing of vegetation within wetland
buffers.
7. Outlot B cannot be developed until: 1) the westerly 500 -foot segment of 54t11 Avenue is
completed (from an emergency -only secondary access route to a city -approved public street);
and 2) Dunkirk Lane along the west boundary of the area as shown on the preliminary plat is
improved.
8. Lot 1, Block 5 cannot be subdivided and developed until: 1) sanitary sewer service is
extended from the north or west; and 2) Dunkirk Lane along the west boundary of the area as
shown on the preliminary plat is improved.
9. The sidewalks along all streets shall be installed at the same time the streets are installed.
10. The developer shall notify potential buyers about fiiture roadway extensions, and shall post
signage on the site regarding fiiture roadway improvements.
11. Looping of the watermain system for the entire development is required prior to, or in
conjunction with, the subdivision and development of Outlot B and Lot 1, Block 5.
12. Until the westerly 500 feet of 54'11 Avenue is constricted in the fiiture to connect to Dunkirk
Lane, an emergency -only access route shall be provided in this location.
13. Standard conditions:
a. No building permits shall be issued until the final plat, HOA documents, and all easements
and agreements are filed and recorded with Hennepin County and proof of recording is
submitted to the city.
b. Any signage shall require separate permits and shall comply with the city's signage
regulations.
c. Development standards and setbacks shall comply with the RSF-3 zoning standards. No
variances are granted or implied.
d. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in
height.
e. Compliance with the city's tree preservation regulations.
f. Removal of all hazardous trees from the property at the owner's expense.

g. A reproducible mylar print and electronic file format (AutoCad DWG file format) of
sanitary sewer, water service, storm sewer and pond as-builts for the site shall be
submitted prior to the release of financial guarantees.
h. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the landowner or applicant has received
prior approval from the city to extend the expiration date for up to one additional year, as
regulated under Section 512 of city code.
