HomeMy WebLinkAboutCity Council Resolution 2011-245CITY OF PLYMOUTH RESOLUTION No. 2011-245 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "ELM CREEK HIGHLANDS EAST" FOR PROPERTY LOCATED NORTH OF SCHMIDT LAKE ROAD AND JEWEL LANE (2010048-F) WHEREAS, Pulte Homes has requested approval of a final plat for 37 single-family lots within the southerly portion of "Elm Creek Highlands East' and three outlots for property legally described as follows: Parcel One. The North 336 feet of the South 2018.6 feet of the West 672 feet of the West half of the Northwest Quarter, Section 8, Township 118, Range 22, Hennepin County, Minnesota. Torrens Property — Certificate No. 1084372 (Commitment file no. 18722) Parcel Two The North 336 feet of the South 1682.6 feet of the West 672 feet of the West half of the Northwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota. Torrens Property — Certificate No. 1098873 (Commitment file no. 18603) Parcel Three The North 336.65 feet of the South 1346.60 feet of the West 672.00 feet of the West half of the Northwest Quarter, Section 8 Township 118, Range 22, Hennepin County, Minnesota. Torrens Property — Certificate No. 683241 (Commitment file no. 1875 1) Resolution 2011-245 File 2010048-F Page 2 WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pulte Homes for a final plat for Elm Creels Highlands East; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Elm Creels Highlands East is approved in accordance with the plans received by the city on June 9, 2011, except as may be amended by this resolution. 2. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Zoning ordinance/ city code requirements: (1) The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. (2) Identify the top and bottom elevation for all retaining walls. Revise plans to identify a three foot safety fence on top of all walls exceeding four feet. (3) Relocate private driveways out of side -yard drainage and utility easements. (4) Revise the landscape plan to provide a 10 -foot, no -mow, low -height landscape plan to be approved by city staff for the 10 feet of right of way adjacent to the ponds in the southwest corner of the plat. b. Assessments/easements/agreements/permit requirements: (1) Water main area charges: Based on 8.43 acres — 0 acres wetland = 8.43 acres. $3,659 per acre x 8.43 = $30,845.37 (2) Sanitary sewer area charges: Based on 8.43 acres — 0 acres wetland = 8.43 acres. $986 per acre x 8.43 = $8,311.98 (3) Submit the two conservation easements in recordable form. The easements shall be recorded with the final plat. Resolution 2011-245 File 2010048-F Page 3 (4) Add conservation easement areas and signage to the grading or landscape plan. (5) Provide a disclaimer to be reviewed and approved by city staff, to be provided to all potential buyers regarding the existence of the gun club, its hours of operation, and that repetitive, loud noise is produced during those hours. (6) Encroachment agreements are required where retaining walls are located in outlots and drainage and utility easements, specifically including: Lots 1, 2, 3, 21, and 22, Block 1, and Lots 12, 13, 14, 15, 16, 17, and 19, Block 2, and Lots 7, 8, 9, and 10, Block 3. The retaining walls in outlot B and outlot C also require encroachment agreements. (7) Submit the deed for outlot B. (8) The homeowner's association documents for Elm Creek Highlands shall be updated to include Elm Creek Highlands East and shall include language to address HOA maintenance of the development retaining walls, plantings in the rights-of-way, sidewalks, and similar features. (9) Obtain applicable permits: a. MPCA for sanitary sewer extension b. Minnesota Department of Health for watermain extension and abandonment of existing wells c. Elm Creek Watershed Commission d. NPDES e. Hennepin County for abandonment of existing septic systems f. City of Plymouth for work in the Schmidt Lake Road right-of-way. c. Grading/ erosion control plan: (1) Use correct standard detail STRT-20 and add detail ST -23. (2) Erosion control blanket must be used on 3:1 slopes and greater. Show appropriate standard detail. d. Street and utility plans: (1) A minimum of one percent slope is required on storm sewer pipe at strictures 203, 204 and 309. (2) Add a note to tie all storm sewer pipe joints between flared end sections and strictures. (3) Add pedestrian crossing and advance pedestrian crossing signs at the crossing on 50th Avenue. (4) Constrict B618 curb across the end of the existing private drive at 51" Avenue terminating at the east property line from the Harvest Hills Addition and install a two foot earth berm across the width of each drive. (5) Add a note to connect to the existing trail on Schmidt Lake Road. (6) Catch basins shall be constricted with a minimum depth of four feet. Resolution 2011-245 File 2010048-F Page 4 (7) Use 15 -inch reinforced concrete pipe (RCP) between catch basin 106 and storm sewer manhole 107. (8) Show sanitary sewer service risers in all profile views. (9) Match inverts and remove drops at sanitary sewer manholes 3, 4, 5, 6 14, 16, and 17. (10) Show a profile view between sanitary sewer manhole 15 and the end of the stub in Jewel Circle (11) Move the hydrant on Jewel Lane from the centerline road station 7+33.15 to the high point in the road. (12) Move the watermain between Lots 22 and 23, Block 2 to the west side of Lot 22, Block 2. (13) Extend sanitary sewer from manhole three to a point 15 feet north of the existing 48 -inch storm sewer along Schmidt Lake Road. (14) Relocate the proposed landscaping off the top of the sanitary sewer extending from manhole three. (15) Use the current version of city standard detail plates, presently dated March 2011. e. Water Resource Plan: (1) Indicate concrete trick washout areas. (2) Update the SWPP plan: 1) include date; 2) use 2011 details; and 3) show the proposed storm sewer strictures. 4. Prior to issuance of building permits, permanent wetland buffer monument signs and conservation easement signs must be installed pursuant to ordinance requirements. 5. The northwest greenway trail along west side of the development shall be constricted with this final plat. 6. The sidewalks along all local streets shall be installed at the same time as the streets and utilities. 7. Standard conditions: a. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. b. The watermain system must be an approved looped system. c. Compliance with the city's tree preservation regulations. d. Removal of all hazardous trees from the property at the owner's expense. e. Any signage shall require separate permits and shall comply with the city's signage regulations. f. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond as-builts for the site shall be submitted prior to the release of financial guarantees. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
