HomeMy WebLinkAboutCity Council Resolution 2011-229CITY OF PLYMOUTH RESOLUTION No. 2011-229 A RESOLUTION ALLOWING A SECOND DRIVEWAY ACCESS FOR LAWRENCE MAROFSKY ON BEHALF OF STEVE AND SHARON ROE WHEREAS, on June 17, 2011, Lawrence Marofsky on behalf of Steve and Sharon Roe requested an appeal of a denial for a second driveway access for property located at 2405 Kirkwood Lane, legally described as that part of Lots I and 2, Block 6, "Elmhurst', lying Southeasterly of a line drawn from the Southwest corner of said Lot 2, to a point on Northeasterly line of said Lot 1, distant 71 feet Northwesterly form the most easterly corner thereof, according to the map or plat thereof on file and of record in the office of the County Recorder in and for said Hennepin County, Minnesota. WHEREAS, when hearing an appeal, the City Council acts in its capacity as the Board of Adjustments and Appeals. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby allow a second driveway access for property located at 2405 Kirkwood Lane, subject to the following findings: 1. City staff incorrectly interpreted the legislative intent of the applicable provisions of the Plymouth Zoning Ordinance, relating to a second driveway access, and denial of the second access was issued in error. 2. The denial is hereby revoked and the Roes may proceed to install a second driveway access. ADOPTED by the City Council this 12th day of July, 2011. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
