RESOLUTION No. 2011-180
A RESOLUTION APPROVING CONDITIONAL USE PERMITS FOR THE CITY OF PLYMOUTH
FOR PLAYFIELD LIGHTING AT ELM CREEK PLAYFIELD LOCATED WEST OF
THE WAYZATA SENIOR HIGH SCHOOL AND ZACHARY PLAYFIELD LOCATED NORTH OF
ROCKFORD ROAD AND WEST OF ZACHARY LANE (2011021)
WHEREAS, The City of Plymouth has requested approval of conditional use permits for
playfield lighting at Elm Creek Playfield and Zachary Playfield, legally described as follows:
Elm Creek Playfield
Lot 2, Block 1, Wayzata Senior High School Addn, according to the recorded plat
thereof, Hennepin County, Minnesota.
Zachary Playfield
Lot 2, Block 2, City of Plymouth Plat No 2, according to the recorded plat thereof,
Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by the City of Plymouth for conditional use permits for lighting at Elm Creek Playfield
and Zachary Playfield, subject to the following conditions:
1. Conditional use permits to allow new lighting for two soccer fields at Elm Creek Playfield
and new lighting at two baseball fields and re -lighting of existing fields at Zachary Playfield
are approved, in accordance with the city's application materials dated April 28, 2011,
except as amended by this resolution.
2. The conditional use permits are approved with the finding that all applicable conditional use
permit standards are met, as follows:
a. the proposed uses would comply with the comprehensive plan;
b. the proposed uses would not be detrimental to, or endanger the public health, safety,
morals, or comfort;

c. the proposed uses would not be injurious to the surrounding properties or to the city as
a whole;
d. the proposed uses would not impede the orderly development of the district;
e. the sites are adequately served by public facilities;
f. the uses would comply with the regulations of the P -I zoning district; and
g. the uses are consistent with the performance standards outlined in section 21015.04 of
the zoning ordinance.
3. Prior to instillation of the lighting, the city shall submit verification by a certified lighting
professional or registered engineer that the lighting systems have received every reasonable
effort to mitigate obtrusive light.
4. The approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
5. The conditional use permits shall expire one year after the date of approval, unless the
property owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the city to extend the expiration
date for up to one additional year, as regulated under sections 21015.07 of the zoning
ordinance.
6. Direct city staff to work with the property owners at 11545 43rd Avenue North (immediately
southwest of the playfield) to develop an appropriate solution to the visual privacy and stray
ball issues that currently exist.
