HomeMy WebLinkAboutCity Council Resolution 2011-175CITY OF PLYMOUTH RESOLUTION No. 2011-175 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "TAYLOR CREEK 2ND ADDITION" FOR PROPERTY LOCATED AT 5600 AND 5660 VICKSBURG LANE (2011013) WHEREAS, Gonyea Company has requested approval of a final plat for 9 single-family lots within the southerly portion of "Wood Crest of Plymouth 2"a Addition" for property legally described as Outlot A, Wood Crest of Plymouth 2"a Addition; and WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Gonyea Company for a final plat for Taylor Creels 2"a Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Taylor Creels 2"a Addition is approved in accordance with the plans received by the city on March 29, 2011, except as may be amended by this resolution. 2. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Zoning ordinance/ city code requirements: (1) The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. Resolution 2011-175 File 2011013 Page 2 (2) The homeowner's association documents shall include language to address HOA maintenance of the development retaining walls, filtration basins, private amenity lot, association common spaces, sidewalks, landscaped areas, and similar features. b. Grading/ erosion control plan: (1) Indicate emergency overflow elevations at the wetland storm sewer crossings and overflows for ponds 1 and 2. (2) Provide a 12 -foot wide access road for maintenance of ponds 1 and 2 within drainage and utility easements. (3) Indicate trail grades between Lots 5 and 6. (4) Confirm that rear yard swales behind Lots 1 thri 3 have a minimum slope of 1.75 percent. (5) Consider leaving existing drive off Vicksburg Lane as access to Pond No. 1. (6) Confirm that the driveway slope for Lot 6 exceeds 2 percent. c. Easements/agreements: (1) Encroachment agreements are required for Lots 1-3, Block 1, where retaining walls would be located in drainage and utility easements. (2) Maintenance agreements are required for the two filtration basins. (3) A ten -foot wide trail easement shall be provided along the west boundary of the plat. d. Street and utility plans: (1) Relocate sidewalk to east side of Upland Lane and connect with trail in cul-de-sac. (2) Indicate location post on end of sanitary sewer stub extending to Vicksburg Lane. (3) Change Sanitary Sewer and Watermain Note 16 to "6 -inch wide external seal wrap." (4) Tie first six pipe joints up stream from Apron A-6. (5) Use the correct standard plate for street name marker. (6) Do not pave the trail until the trail section in Wood Crest of Plymouth 2"a Addition is ready to be paved. 4. Prior to recording the final plat, the final plat for Wood Crest of Plymouth 2"a Addition shall be recorded with Hennepin County. 5. Prior to recording the final plat, the existing strictures shall be removed from the site. Demolition permits are required for removal of existing strictures. Prior to issuance of a grading permit or any grading activities, the developer shall install and request inspection of tree preservation fencing and silt fencing. 7. Prior to issuance of building permits, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 8. The sidewalks along all streets shall be installed when the streets are installed. 9. The developer shall notify potential buyers about the future street improvement project for Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway improvement. 10. Standard conditions: a. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. b. The watermain system must be an approved looped system. c. Compliance with the city's tree preservation regulations. d. Removal of all hazardous trees from the property at the owner's expense. e. Any signage shall require separate permits and shall comply with the city's signage regulations. f. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond as-builts for the site shall be submitted prior to the release of financial guarantees. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
