HomeMy WebLinkAboutCity Council Resolution 2011-173CITY OF PLYMOUTH RESOLUTION No. 2011-173 A RESOLUTION TO APPROVE A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMITS FOR BAUER DESIGN BUILD, LLC, TO CONSTRUCT A 19,200 -SQUARE FOOT EXPANSION FOR TWIN CITY FAN COMPANIES LOCATED AT 5959 TRENTON (201 101 5) WHEREAS, Bauer Design Build, LLC, has requested approval of a site plan amendment and conditional use permits to constrict a 19,200 -square foot building and parking expansion for property legally described as: Lot 2, Block 2, Bass Creek Business Park Addition, according to the recorded plat thereof, Hennepin County, Minnesota. TO -91 The Northerly 151.08 feet of Lot 1, Block 2, Bass Creek Business Park Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Bauer Design Build, LLC, for a site plan amendment and conditional use permits to allow a 19,200 -square foot building and parking expansion, subject to the following conditions: 1. A site plan amendment is approved for to allow a 19,200 -square foot building, a 54 -stall parking expansion and related site improvements, in accordance with the plans received by the city on March 31, 2011 and revised plans received on May 6, 2011, except as may be amended by this resolution. 2. Conditional use permits are approved to allow up to 62 -percent office use within the buildings and to allow two principal buildings on one lot, with the finding that the applicable CUP standards are met. 3. A separate building permit is required prior to commencement of the proiect. 4. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Complete a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. Resolution 2011-173 File No. 2011015 Page 2 b. Complete a transportation demand management (TDM) plan for the site to be reviewed and approved by city staff c. Revise plans to add "no parking" signage at the snow storage area. d. Submit a revised lighting plan in compliance with the shielding and maximum wattage requirements of section 21105.06 of the zoning ordinance. e. Agreements: 1. Submit a maintenance agreement for the rain gardens. f. Applicable Permits: 1. Shingle Creek Watershed Management Organization. 2. NPDES. g. Grading and Drainage Plan: 1. All details shown need to be the current City of Plymouth approved details, presently dated March, 2011. 2. Call out emergency overflow elevations for both rain gardens and the existing pond in the southeast corner of the site. 3. Provide planting schedules on the plan for both rain gardens. h. Utility Plan: 1. Replace the two existing storm sewer strictures adjacent to Trenton Lane or core drill new pipe openings and seal the old pipe openings. i. Water Resources Plan: 1. This project does not meet city total suspended solids (TSS), phosphorus, volume and rate control requirements. 2. Explain existing conditions subcatchment basin 5S, as 5S is not indicated on the plan sheet. 3. Hydrocad outputs do not match Table 1.1 for 1P (10 -year proposed and 100 -year proposed) and 4P (two-year proposed, 10 -year proposed and 100 -year proposed). 4. Hydrologic soil group D is used for all subcatchments. However, pond 3P is within subcatchment 30S and appears to have no outlet and infiltrates 100 percent of surface water draining to it. j. Provide double sided fire lane signs in approved locations on: 1) both sides of the main drive aisle; 2) the east and west entry drives to the new building; and 3) the drive aisle on the east side of the existing building. k. Submit turning radius evaluations from the main drive aisle to the east and west drives to the new building. The evaluations must be based on the fire department apparatus specifications. The evaluation must prove that the apparatus does not come in contact with curbs, objects, and extend into any designated parking spaces. 5. Silt fence shall be installed prior to any constriction on the site. 6. The color of the proposed building shall match the color of the existing building. 7. All rooftop equipment shall be screened or painted to match the building. 8. Standard Conditions: Resolution 2011-173 File No. 2011015 Page 3 a. The applicant shall remove any diseased or hazardous trees. b. New signage shall receive sign permits when required and shall comply with the section 21155 of the zoning ordinance. c. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. d. The site plan and conditional use permits shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21015.07 respectively, of the zoning ordinance.
