HomeMy WebLinkAboutCity Council Resolution 2011-171CITY OF PLYMOUTH RESOLUTION No. 2011-171 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "HAMPTON HILLS 3RD ADDITION" FOR PROPERTY LOCATED AT 53131 53231AND 5455 JUNEAU LANE (2011002-F) WI-1EREAS, Hampton Hills Investment, LLC has requested approval of a final plat for 33 new single-family lots and 4 outlots on roughly 151 acres of land located at 5313, 5323, and 5455 Juneau Lane; and WIffiREAS, the property is presently legally described as follows: Lot 1, Block 2 and Outlot A, Hampton Hills 2"a Addition, Hennepin County, Minnesota. ►It Tract A, Registered Land Survey No. 1618, Hennepin County, Minnesota, except that part thereof which lies easterly and northerly of the following described line: Commencing at the northwest corner of said Tract A; thence on an assumed bearing of South 89 degrees 55 minutes 03 seconds East along the northerly line of said Tract A a distance of 430.00 feet to the point of beginning of the line to be described; thence South 17 degrees 02 minutes 42 seconds East a distance of 408.70 feet; thence on a bearing of East to the east line of said Tract A and said line there terminating. Tract B, Registered Land Survey No. 1618, Hennepin County, Minnesota. That part of Government Lot 3, Section 4, Township 118, Range 22, lying Southerly of Registered Land Survey No. 1618, Hennepin County, Minnesota. ►I9 Resolution 2011-171 File 2011002 Page 2 The property included within the following area: Commencing at the Northeast corner of the Northwest Quarter of Section 9, Township 118, Range 22; thence Westerly along the North line of said section to a point 1,000 feet from said corner; thence Southwesterly to a point on the East line of the Northwest Quarter of Section 9 distant 1,000 feet Southerly from the Northeast corner of said section; thence Northerly along the East line of the Northwest Quarter of Section 9, to the point of beginning, Hennepin County, Minnesota. M Government Lot 1, Section 9, Township 118, Range 22, and that part of the Southwest Quarter of the Northeast Quarter of Section 9, Township 118, Range 22, lying Northerly of the Railroad Right of Way, Hennepin County, Minnesota. That part of Government Lot 2, Section 9, Township 118, Range 22, lying Northerly of the Railroad Right of Way, and that part of the Southeast Quarter of the Northeast Quarter of Section 9, Township 118, Range 22, lying Northerly of the Railroad Right of Way, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hampton Hills Investment, LLC for a final plat for Hampton Hills 3'a Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Hampton Hills -1 Addition is approved in accordance with the plans received by the city on March 30, 2011, except as may be amended by this resolution. 2. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Grading/ erosion control plan: (1) Realign the trail over storm sewer line A west of Station 2+00 so the trail is not on top of the pipe. Realign the trail to cross over the reinforced concrete pipe between storm sewer manhole 5 and pipe apron 1. (2) Identify the emergency overflow elevation for Lots 4-5 of Block 3. The lowest opening elevation for those two lots must be at least 18 inches above the emergency overflow elevation. (3) Refer to filtration shelf areas, not rain gardens, in Note 3 of Filtration Shelf Notes. b. Easements/agreements: (1) Provide an easement for the temporary cul-de-sac located at the south end of Polaris Lane. (2) Revise the plat to provide a lot for the existing home located on property presently described as Lot 1, Block 2, Hampton Hills 2nd Addition. (3) Label existing Tracts C and D of RLS No. 1618 on the plat. (4) For Outlots B and D, provide 10 -foot wide drainage and utility easements where the Outlots abut Polaris Lane and Juneau Lane. (5) For Outlot D, provide 6 -foot wide drainage and utility easements along its boundary between Outlot B and the Canadian Pacific railroad, along its boundary with the Glacier Vista and The Reserve 2"a Addition subdivisions, and along its boundary between Juneau Lane and the west line of RLS No. 1618. (6) Show Outlot labels in bold lettering on the plat. (7) Furnish curve data information for the northwest corner of Outlot B. (8) A separate access easement is required for the existing home at 5323 Juneau Lane. (9) Confirm whether the resident at 5323 Juneau Lane is to be included on the signature sheet of the plat. (10) Encroachment agreements are required for Lots 6-10, Block 3, where retaining walls would be located in drainage and utility easements. (11) Maintenance agreements are required for filtration shelves. c. Street and utility plans: (1) Lengthen the vertical curves on Orchid Lane at Stations 2+50 and 4+50 to 75 feet. (2) Eliminate bends from sewer services. (3) Tie all pipe joints between storm sewer control strictures and aprons and culvert aprons. Resolution 2011-171 File 2011002 Page 4 (4) Provide additional cover over the top of the sewer stub out of manhole 14 and insulate as needed. (5) Furnish a quantity for the Flex -A -Mat on the storm sewer stricture schedule. (6) Use the correct standard plate for street name markers. (7) Show storm sewer line A in profile for storm sewer line D. (8) Furnish and install geogrid under storm sewer line D. (9) Provide reinforced concrete pipe from storm sewer manhole 5 to pipe apron 1. (10) Provide corrugated metal pipe aprons for pipe aprons 3 and 4. (11) Install a cleanout on the upstream end of the drain tile extending from catch basin 20. (12) Place drain tile lines in Block 2 within drainage and utility easements. (13) Provide a 3 percent slope between Stations 0+00 and 0+25 on Polaris Lane. (14) Demonstrate how access will be provided or preserved for 5323 Juneau Lane. 4. Prior to impacting any wetlands, the developer shall receive city council approval of the wetland replacement plan and staff approval of a grading permit. 5. Prior to issuance of a grading permit or any grading activities, the developer shall install and request inspection of tree preservation fencing and silt fencing. 6. Prior to issuance of building permits, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 7. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of wetland buffers, buffer monuments, developer -installed retaining walls, filtration basins, association common spaces, sidewalks, landscaped areas, and similar features; and b) prohibition on strictures and the clearing of vegetation from the wetland buffers. 8. The sidewalks along all streets shall be installed when the streets are installed. 9. The developer shall notify potential buyers about fi ture roadway extensions, and shall post signage on the site regarding fi ture roadway improvements. 10. Standard conditions: a. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. b. The watermain system must be an approved looped system. c. Compliance with the city's tree preservation regulations. d. Removal of all hazardous trees from the property at the owner's expense. e. Any signage shall require separate permits and shall comply with the city's signage regulations. Resolution 2011-171 File 2011002 Page 5 f. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond as-builts for the site shall be submitted prior to the release of financial guarantees. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
