HomeMy WebLinkAboutCity Council Resolution 2011-169CITY OF PLYMOUTH RESOLUTION No. 2011-169 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "WOOD CREST OF PLYMOUTH 2ND ADDITION" FOR PROPERTY LOCATED AT 5600 AND 5660 VICKSBURG LANE (2010094-F) WHEREAS, Wood Crest Development of Plymouth, LLC has requested approval of a final plat for 31 new single-family lots, replatting of two existing single-family lots and an existing private amenity lot, and one outlot (to be platted for nine new single-family lots as Taylor Creek 211a Addition) on roughly 20 acres of land located at 5600 and 5660 Vicksburg Lane; and WHEREAS, the property is presently legally described as follows: The South Half of the Northwest Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, West of the 5t1' Principal Meridian, according to the United States Government Survey thereof and situate in Hennepin County, Minnesota. m Outlot B and Lot 1, Block 4, Wood Crest of Plymouth, Hennepin County, Minnesota. M Outlot B, Lot 3, Block 1, and Lot 1, Block 2, Taylor Creek, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Wood Crest Development of Plymouth, LLC for a final plat for Wood Crest of Plymouth 2"a Addition; and Resolution 2011-169 File 2010094-F Page 2 FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Wood Crest of Plymouth 2"a Addition is approved in accordance with the plans received by the city on March 29, 2011 and revised plat received by the city on May 3, 2011, except as may be amended by this resolution. 2. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Zoning ordinance/ city code requirements: (1) The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. (2) The homeowner's association documents shall include language to address HOA maintenance of the development retaining walls, filtration basins, private amenity lot, association common spaces, sidewalks, landscaped areas, and similar features. b. Grading/ erosion control plan: (1) Revise plans to indicate the emergency overflow elevations at the wetland storm sewer crossings and the overflows for ponds 1 and 2. (2) The emergency overflow elevation between Lots 6 and 7 of Block 3 cannot exceed 973.5. (3) Revise plans to indicate a drainage swale slope for Lots 3 thri 6 of Block 1. Consider installation of drain tile. (4) Constrict a 12 -foot wide access road for maintenance of ponds 1 and 2. (5) Demonstrate how pedestrian access will be provided to the private park. (6) Indicate the trail grades between Lots 3 and 4 of Block 3. (7) Refer to filtration shelf areas, not rain gardens, in Note 3 of Filtration Shelf Notes. Resolution 2011-169 File 2010094-F Page 3 c. Easements/agreements: (1) Expand the drainage and utility easement on Lot 17 of Block 3 to accommodate both the sanitary sewer and watermain. (2) Provide a 15 -foot wide maintenance access easement for maintenance of ponds 1 and 2. (3) A temporary grading easement may be required from the properties to the south to constrict ponds 1 and 2. (4) Encroachment agreements are required for Lots 6-8, Block 1 and Lots 11 and 16, Block 3, where retaining walls would be located in drainage and utility easements. (5) Maintenance agreements are required for filtration shelves. (6) A ten -foot wide trail easement shall be provided along the west boundary of the plat. d. Street and utility plans: (1) Indicate and provide a "No Outlet' sign on 56"' Avenue at the 57"' Avenue intersection (note that this is not needed if there is already one at the 57"' Avenue/Vicksburg intersection). (2) Indicate the existing sidewalk on 57"' Avenue and connection of the new sidewalk on 56"' Avenue. (3) Do not pave the trail until the trail section in Taylor Creek 2"a is ready to be paved. (4) Tie all pipe joints between storm sewer control strictures and aprons and culvert aprons. (5) A 12 -inch watermain is not required in 56"' Avenue. The city will not participate in oversizing costs for a 12 -inch watermain. (6) Indicate proposed stationing for sanitary sewer and water services. (7) Use 10 -inch HDPE for watermain installation between Lot 17 of Block 3 and 55t1' Court in Hampton Hills 2"a Addition. (8) Use the correct standard plate for street name markers. 4. Prior to recording the final plat, the existing strictures shall be removed from the site. Demolition permits are required for removal of existing strictures. 5. Prior to impacting any wetlands, the developer shall receive city council approval of the wetland replacement plan and staff approval of a grading permit. 6. Prior to issuance of a grading permit or any grading activities, the developer shall install and request inspection of tree preservation fencing and silt fencing. Resolution 2011-169 File 2010094-F Page 4 7. Prior to issuance of building permits, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 8. The sidewalks along all streets shall be installed when the streets are installed. 9. The sidewalk along the front (east side) of Lot I of Block 3 shall extend northerly to 57t11 Avenue. 10. The homeowner's association (HOA) shall be responsible for maintaining the sidewalk along Shenandoah Lane. 11. The developer shall notify potential buyers of those lots abutting the east border of the plat about city plans for a fiiture north/south trailway to be located immediately east of the plat to provide access between that area and the Northwest Greenway corridor. 12. The developer shall notify potential buyers about fiiture roadway extensions and about the fiiture street improvement project for Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway improvements. 13. Standard conditions: a. Development standards and setbacks shall comply with the RSF-3 zoning standards. No variances are granted or implied. b. Any signage shall require separate permits and shall comply with the city's signage regulations. c. Compliance with the city's tree preservation regulations. d. Removal of all hazardous trees from the property at the owner's expense. e. Relocate fire hydrants to locations as approved by the Fire Inspector. f. The watermains must be an approved looped system. g. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond as-builts for the site shall be submitted prior to the release of financial guarantees. h. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
