HomeMy WebLinkAboutCity Council Resolution 2015-290CITY OF PLYMOUTH RESOLUTION No. 2015-290 RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR "WOOD CREST HILLS 2ND ADDITION" FOR PROPERTY LOCATED AT 5975 VICKSBURG LANE (2015058) WHEREAS, Bradley Cheney has requested approval of a preliminary and final plat for the roughly five -acre parcel presently legally described as the north 300 feet of the south 1,230 feet of the east 759 feet of the northeast quarter of section 5, township 118, Range 22, Hennepin County, Minnesota; and, WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly called public hearing and recommends approval; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Bradley Cheney for a preliminary and final plat for "Wood Crest Hills 2nd Addition, subject to the following conditions: 1. A preliminary and final plat is approved to allow the property to be subdivided into two lots for single- family homes, in accordance with the application and plans received by the city on July 6 and 29, 2015, except as may be amended by this resolution. 2. Approval of the preliminary and final plat is contingent upon City Council approval of the rezoning of the west side of the site to RSF-3. 3. Prior to recording the final plat, the applicant shall pay park dedication fees for one new lot and revise the plans to 1) add a buffer monument on the east side of Lot 2 where the buffer crosses the property line and 2) revise the plan to expand the drainage and utility easement over the drainage swale on Lot 1, consistent with the applicable city code, zoning ordinance, and engineering guidelines. 4. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 5. When further subdivision or development of Lot 1, Block 1(5975 Vicksburg Lane) occurs, all proposed lots and/or buildings shall be served with city sewer and trunk water and sewer area assessments shall be levied against the property. At that time, on-site sanitary systems must be removed or abandoned in accordance with state and county regulations. 6. When further subdivision or development of Lot 1, Block 1 (5975 Vicksburg Lane) occurs, the development shall be subject to park dedication and wetland buffer requirements consistent with the zoning ordinance, subdivision regulations or city code at that time. 7. Standard Conditions: Res. 2015-290 File 2015058 Page 2 a. All retaining walls over four feet shall require issuance of a building permit and a three-foot fence installed on top of the wall. b. Compliance with the city's tree preservation regulations. c. No trees shall be planted in the public right-of-way. d. Removal of all hazardous trees from the property at the owner's expense. e. This approval shall expire two years after the date of approval, unless the applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
