HomeMy WebLinkAboutCity Council Resolution 2015-289CITY OF PLYMOUTH RESOLUTION NO. 2015-289 RESOLUTION APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 5975 JUNEAU LANE (2015058) WHEREAS, Bradley Cheney has requested reclassification of the zoning from FRD (future restricted development) to RSF-3 (single family 3) for the west portion of the roughly five -acre site presently legally described as follows: That part of the North 300 feet of the South 1230 feet of East 759 of Northeast 1/4 of Section 5, Township 118, Range 22, Hennepin County, Minnesota described as beginning at the southwest corner thereof; thence on an assumed bearing of North 89 degrees 32 minutes 29 seconds East, along the south line thereof, a distance of 260.10 feet; thence North 09 degrees 19 minutes 31 seconds West a distance of 98.71 feet; thence North 34 degrees 20 minutes 57 seconds West a distance of 129.47 feet; thence South 89 degrees 32 minutes 29 seconds West a distance of 170.93 feet to the west line of said East 795 feet of the Northeast 1/4 of Section 5; thence South 00 degrees 02 minutes 02 seconds West 205.01 to the point of beginning; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to RSF-3. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-3 for the west portion of the roughly five -acre site located at 5975 Vicksburg Lane, based on the following findings: 1. The RSF-3 zoning would be consistent with the LA -R3 guiding, pursuant to the comprehensive plan. 2. The proposed single-family use on Lot 2 would be consistent with the comprehensive plan, would comply with city standards and would be consistent with abutting lots. 3. Adequate infrastructure would be available to support the home on Lot 2. 4. The distance and grade change between the buildable area on Lots 1 and 2 allow for adequate transition between the newly proposed home and any future development.
