HomeMy WebLinkAboutCity Council Resolution 2015-278CITY OF PLYMOUTH RESOLUTION NO. 2015-278 RESOLUTION APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 17210 COUNTY ROAD 47 (2015065) WHEREAS, OP4 The Pines, LLC has requested reclassification of the zoning from FRD (future restricted development) to RSF-3 (single family detached 3) for 3.07 acres of 17210 County Road 47 lying west of Elm Creek, and legally described as follows: That part of the East Half of the following described parcel: Beginning at the southwest corner of the North Half of the Northwest Quarter of Section 5, Township 118, Range 22; thence North 89 degrees 21 minutes 02 seconds East, along the south line of said North Half of the Northwest Quarter of Section 5 a distance of 1333.00 feet; thence North 00 degrees 57 minutes 50 seconds East, parallel with said west line of the North Half of the Northwest Quarter, a distance of 704.00 feet; thence South 89 degrees 21 minutes 02 seconds West, parallel with said south line of the North Half of the Northwest Quarter, a distance of 1333.00 feet to said west line of the North Half of the Northwest Quarter of Section 5; thence South 00 degrees 57 minutes 50 seconds West a distance of 704.00 feet to the point of beginning. Lying northerly, northwesterly and westerly of the following described line: Beginning at the southwest corner of the North Half of the Northwest Quarter; thence North 89 degrees 21 minutes 02 seconds East, along the south line of said North Half of the Northwest Quarter of Section 5 a distance of 666.50 feet to the southwest corner of said East Half; thence North 00 degrees 57 minutes 50 seconds East along the west line of the East Half of the above described parcel a distance of 56.40 feet to the point of beginning of said line; thence North 89 degrees 15 minutes 32 seconds East a distance of 37.58 feet; thence on a bearing of North a distance of 31.95 feet; thence North 35 degrees 06 minutes 32 seconds East a distance of 110.56 feet; thence North 41 degrees 10 minutes 56 seconds East a distance of 258.01 feet; thence North 13 degrees 59 minutes 05 seconds West a distance of 92.53 feet; thence North 00 degrees 11 minutes 29 seconds West a distance of 83.49 feet; thence North 38 degrees 18 minutes 48 seconds East a distance of 205.59 feet to the north line of the above described parcel and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to RSF-3. Resolution 2015-278 (2015065) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-3 for 3.07 acres of 17210 County Road 47 lying west of Elm Creek (as legally described above), based on the following findings: 1. The requested RSF-3 zoning is consistent with the LA -2 guiding of the site. 2. The proposed density and single-family development is consistent with LA -2 guiding of the site. 3. The residential development and lot arrangement would comply with city standards. 4. Adequate infrastructure would be available to support the proposed development.
