HomeMy WebLinkAboutCity Council Resolution 2011-126CITY OF PLYMOUTH RESOLUTION No. 2011-126 A RESOLUTION APPROVING A PUD GENERAL PLAN TO ALLOW A 157 -UNIT APARTMENT BUILDING FOR PROPERTIES LOCATED AT 9805 AND 9855 HIGHWAY 55 (2010086) WHEREAS, Quest Development, Inc., has requested approval of a PUD general plan for property legally described as follows: Lots 1 and 2, Block 1, Homestead Village Incorporated, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by Quest Development, Inc. for a PUD general plan at 9805 and 9855 Highway 55, subject to the following conditions: 1. A PUD general plan is approved to constrict a 157 -unit apartment building according to the plans received by the city on October 19 and 26, 2010, December 10, 2010, and January 21, 2011, except as amended by this resolution. 2. Approval of the PUD general plan is contingent upon City Council approval of the comprehensive plan amendment and rezoning of the site. 3. Development standards and setbacks for this PUD shall comply with the RMF -5 zoning standards, except as otherwise indicated on the PUD site plan dated December 10, 2010. 4. This PUD general plan includes approval of the following: a.) Parking spaces provided at 1.73 spaces per unit; b.) Wetland buffer setbacks of five feet for the parking area as shown on the plans; c.) The absence of window articulation; and, d.) Landscaping at .55 trees per unit. 5. Prior to commencement of the building constriction, the applicant shall obtain a building permit. 6. No building permits shall be issued until a PUD final plan is submitted to and approved by city staff. 7. As part of the PUD final plan application, the applicant shall submit the following plans and materials consistent with city requirements: a) Easements, agreements, and permits: Resolution 2011-126 File No. 2010086 Page 2 1) An access easement for the storm water pond. 2) A request to vacate a portion of an existing drainage and utility easement on the south end of Lot 2 to accommodate proposed building and parking lot improvements. 3) Additional drainage and utility easements for the proposed storm water pond and for the enlarged flood storage area. 4) A maintenance agreement for the irrigation tank and infiltration basin. 5) An encroachment agreement for the portion of the retaining wall that lies within drainage and utility easements. b) Amend the plans to be consistent with the sketch submitted February 10, 2011 and shift the centerline of the north driveway to match the centerline of the roadway to the extent possible while meeting the 10 -foot setback to the north property line. c) Amend the grading and erosion control plan to 1) include the wetland buffer monuments and 2) show the wetland mitigation area as approved in 2004. d) Amend the site plan to include compact parking signage as required by section 21135 of the zoning ordinance. e) Amend the elevation plans consistent with the sketch submitted March 29, 2011. f) Amend the elevation plans to add notes indicating that: 1) vents for heating/cooling/ventilation equipment shall be painted to blend in with the building materials and 2) any mechanical equipment shall be screened as required by the zoning ordinance. g) Revise the landscaping plan: 1) Identify the number and specie of each tree proposed on the graphic consistent with the tables. 2) Revise the shrub quantity, location and specie in the southwest corner of the building as may be necessary to ensure the area fiunctions as flood storage. 3) Substitute six-foot arborvitae for the three-foot arborvitae shown along the Highway 55 right-of-way to provide additional screening. 4) Substitute 30 long-lived trees (3.5 caliper inches for deciduous or eight feet in height for coniferous trees) for 30 of the 2.5 caliper inch/six-foot overstory trees. h) Consider substituting the DD lighting fixture for the WWI fixtures shown to be installed on the fence around the courtyard or submit installation information for the WWI fixtures. i) Street and utility plans: 1) Relocate the hydrants and fire lane signs to approved locations. 2) Identify the fire department connection at the main entry door on the northeast side of the building. 3) An eight -inch water service is necessary to meet fire protection requirements. Resolution 2011-126 File No. 2010086 Page 3 4) Avoid excavation in Nathan Lane for sewer and water connections. 5) Confirm with the supplier whether an additional inspection manhole is required at the east end of the irrigation tank and submit a copy of the information provided. 6) Replace the cross gutter at the northeast corner of Nathan Lane and the Highway 55 frontage road with 136/18 curb. 8. Prior to issuance of a building permit, the applicant shall: a) Execute a site improvement performance agreement and submit the applicable financial guarantees. b) Submit proof of recording for all required vacations, easements and agreements. c) Install silt fence and/or tree preservation fencing and request inspections. d) Pay park dedication fees consistent with section 528 of city code as established at the time the permit is issued. e) Submit permits from the following agencies: Bassett Creek Watershed District, NPDES, City of Plymouth right-of-way and building/demolition permits, MnDOT right-of-way, and Army Corps of Engineers for work within the Bassett Creek floodplain. 9. All signage shall require separate permits and shall be in conformance with the requirements for residential districts as defined in the zoning ordinance. 10. The previously approved wetland mitigation shall occur with this project. 11. No recreational vehicles or equipment may be stored in interior or exterior parking space. 12. Mechanical equipment shall be screened as required by section 21130.05 of the zoning ordinance. 13. All garbage and recycling shall be stored inside the principal building. 14. Building permits shall be required for retaining walls 48 inches in height or higher. Additionally, a fence a minimum of three feet in height shall be installed at the top of retaining walls that exceed four feet in height. ADOPTED by the City Council on April 12, 2011.
