HomeMy WebLinkAboutCity Council Resolution 2011-104CITY OF PLYMOUTH RESOLUTION No. 2011-104 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR HAMPTON HILLS INVESTMENT, LLC, FOR "HAMPTON HILLS 3RD ADDITION" FOR PROPERTY LOCATED AT 5313, 5323, AND 5455 JUNEAU LANE (2011002) WHEREAS, Hampton Hills Investment, LLC, has requested approval of a preliminary plat for the roughly 151 -acre site presently legally described as follows: Lot 1, Block 2 and Outlot A, Hampton Hills 2" a Addition, Hennepin County, Minnesota. Tract A, Registered Land Survey No. 1618, Hennepin County, Minnesota, except that part thereof which lies easterly and northerly of the following described line: Commencing at the northwest corner of said Tract A; thence on an assumed bearing of South 89 degrees 55 minutes 03 seconds East along the northerly line of said Tract A a distance of 430.00 feet to the point of beginning of the line to be described; thence South 17 degrees 02 minutes 42 seconds East a distance of 408.70 feet; thence on a bearing of East to the east line of said Tract A and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hampton Hills Investment, LLC, for a preliminary plat for Hampton Hills -1 Addition, subject to the following conditions: 1. A preliminary plat is approved to allow a 114 -lot single-family subdivision, in accordance with the plat and plans received by the city on March 4, 2011, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site to RSF-3. 3. The developer must obtain approval of the wetland replacement plan application prior to, or in conjunction with, approval of the first final plat application for this development. 4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Assessment/ easement/ agreement/ permit requirements: (1) Payment of watermain area charges and sanitary sewer area charges. (2) Separate unobstructed maintenance access easements shall be provided for the water quality ponds and sanitary sewer manholes outside the street right-of-way. The access must be 15 feet wide and have a slope of less than ten percent with a 12 -foot wide driving surface capable of supporting maintenance equipment. (3) A temporary easement for grading purposes shall be provided to constrict the temporary cul-de-sac turn -around on the north end of Niagara Lane. (4) An access easement shall be provided for the civil defense siren to be located on the site. (5) Encroachment agreements shall be provided where retaining walls are located in drainage and utility easements. (6) Maintenance agreements shall be provided for the ponds and infiltration basins. Resolution 2011-104 File 2011002 Page 3 (7) Prior to any installation of utilities or constriction, the applicant shall obtain the necessary, applicable permits and approvals as follows: MPCA, Minnesota Department of Health, Shingle Creek Watershed Management Commission, NPDES, Hennepin County, and City of Plymouth. b. Grading and erosion control plans: (1) Indicate the location of the concrete trick washout station on the grading and drainage plan and include a detail on the detail sheet. (2) Indicate how drainage will move around the homes on Lots 1-5 of Block 3 and Lots 14 and 15 of Block 8. (3) Indicate the elevation of the existing home at 5741 Juneau Lane. (4) Indicate the emergency overflow (EOF) elevations between Lots 3 and 4 of Block 2, between Lot 8 of Block 1 and Lot 1 of Block 5, between Lots 8 and 9 of Block 9, and between Lots 13 and 14 of Block 5. (5) Emergency overflow (EOF) elevations may be required behind Lots 4 and 5 of Block 7. (6) Indicate emergency overflow (EOF) elevations between the ponds and wetlands. (7) Indicate the floodplain elevation for Bass Creek. (8) Indicate the normal water level (NWL), high water level (HWL), and emergency overflow elevations for wetlands 3 and 6 in the west portion of the site. (9) Provide additional detail regarding how drainage will cross the trail from wetland (10) Indicate the centerline elevation of the cul-de-sac turn -around for Lots 12-14 of Block 5. (11) Indicate the fiiture civil defense siren location in the vicinity of Lots 12-14 of Block 8. (12) Adjust the garage floor elevations of Lot 13 of Block 2, Lot 1 of Block 6, and of Lots 8, 9 and 13 of Block 9 to provide minimum grades of two percent slopes toward the streets. (13) Indicate how surface drainage will be managed above and around the retaining wall on Lots 6 thri 11 of Block 3. (14) Indicate a rock constriction entrance on Orchid Lane at 55th Avenue and on the north end of Juneau Lane. (15) Indicate how the inlets for all catch basins will be protected. c. Street and utility plans: (1) The proximity of the water main to the existing septic system on the north end of Niagara Lane may not meet Minnesota Department of Health standards for separation—adjust as needed. (2) Indicate all existing water main valves on 55th Avenue at the intersections of Polaris Lane and Orchid Lane. Resolution 2011-104 File 2011002 Page 4 (3) Add a storm sewer manhole at the intersection of 52nd Avenue and its cul-de-sac turn -around serving Lots 12-14 of Block 5 to keep the pipes between curbs. (4) Move the water main on Juneau Lane to the east side of the street, extend it to the plat boundary, and add a gate valve at 52nd Avenue. (5) Add cover over the sanitary sewer pipe west of manhole 35. (6) Indicate the sanitary sewer pipe depth between manhole 35 and manhole 36. (7) Development of Blocks 10 and I I cannot occur until the street and watermain are extended through the future Taylor Creek development to the west. (8) Looping of the watermain to the 54th Avenue segment lying east of Pomerleau Lake may be necessary to satisfy fire flow requirements for the development. (9) A bituminous overlay is required between the fiiture 57th Avenue intersection with Juneau Lane and the southerly end of existing Juneau Lane, at such time as the final platting connects the street system to Juneau Lane. (10) Extend maintenance access to storm sewer manhole 5 (adjacent to Pond HH -1) and to storm sewer manhole 28 (adjacent to Pond HH -2). d. Water resource plan: (1) A stormwater pollution prevention (SWPP) plan needs to be added to the plan set, along with responsible parties and contact information. (2) Indicate the correct wetland buffers and setbacks next to mitigation areas. (3) Submit drainage calculations that demonstrate compliance with requirements for total suspended solids (TSS) and phosphorus for all areas draining to the ponds. 5. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of wetland buffers, buffer monuments, developer -installed retaining walls, and sidewalks. b) responsibilities for retaining walls that cross or are adjacent to property lines; and c) prohibition on strictures and the clearing of vegetation from the wetland buffers. 6. The sidewalks along all streets shall be installed at the same time the streets are installed. 7. Standard conditions: a. No building permits shall be issued until the final plat, HOA documents, and all easements and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall comply with the city's signage regulations. c. Development standards and setbacks shall comply with the RSF-3 zoning standards. No variances are granted or implied. d. Street names shall comply with the city's street naming system. Resolution 2011-104 File 2011002 Page 5 e. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. f. Compliance with the city's tree preservation regulations. g. Removal of all hazardous trees from the property at the owner's expense. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has recorded a final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of City Code.
