A RESOLUTION APPROVING EASEMENT AGREEMENT
FOR THE CIMARRON PONDS STREET RECONSTRUCTION PROJECT
CITY PROJECT NO. 9113
WHEREAS, an Easement Agreement has been prepared between the City and the
Cimarron Ponds Home Owners Association, owners of the Common Area which is legally
described as Lot 46, Block 1, and Lot 59, Block 2, Cimarron Ponds, Hennepin County,
Minnesota, which is registered land with Certificate of Title No. 131811, and Lot 63, Block 1,
and Lot 69, Block 2, Cimarron Ponds 2" a Addition, Hennepin County, Minnesota, which is
registered land with Certificate of Title No. 562401, for public roadway and drainage and
utility purposes; and
WHEREAS, said Easement Agreement has been signed by the Cimarron Ponds
Homeowners Association and it is recommended for approval to the City Council; and
WHEREAS, recording of the Easement Agreement shall constitute accepting the
Cimarron Ponds private streets in accordance with City Policy.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA that the Easement Agreement for the
Common Area which is legally described as Lot 46, Block 1, and Lot 59, Block 2, Cimarron
Ponds, Hennepin County, Minnesota, which is registered land with Certificate of Title
No. 131811, and Lot 63, Block 1, and Lot 69, Block 2, Cimarron Ponds 2" a Addition,
Hennepin County, Minnesota, which is registered land with Certificate of Title No. 562401,
between the City and the Cimarron Ponds Homeowners Association is approved, and the
Mayor and City Manager are authorized to sign the agreement on behalf of the City.
