RESOLUTION No. 2011-083
A RESOLUTION APPROVING A FINAL PLAT AND AMENDED DEVELOPMENT CONTRACT FOR
MFRA, INC. FOR "ARBOR GROVE 2ND ADDITION" FOR PROPERTY LOCATED SOUTH OF
THE INTERSECTION OF 46TH AVENUE AND YELLOWSTONE LANE (201 1004)
WHEREAS MRFA, Inc. has requested approval of a final plat and amended development
contract for the remaining 10 lots on this 11.9 acres of land located south of the intersection of
46th Avenue and Yellowstone Lane;
WHEREAS, the property is presently legally described as follows:
Outlot A and Outlot B, Arbor Grove, according to the recorded plat thereof,
Hennepin County, Minnesota.
WHEREAS, the city staff has prepared an amendment to the development contract for
Arbor Grove covering the improvements related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by MFRA, Inc. for a final plat for Arbor Grove 2" a Addition; and
FURTHER, that the amended development contract for said plat be approved, and that
upon prior execution of the amended development contract by the developer, the Mayor and City
Manager be authorized to execute the contract on behalf of the city; and,
FURTHER, that the following conditions be met prior to recording of, and related to said
plat unless otherwise specified;
1. A final plat is approved for the creation of 10 lots for single-family homes and two outlots to
be called Arbor Grove 2" a Addition, in accordance with the plat and plans received by the
city on February 9, 2011, except as may be amended by this resolution.
2. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances
are approved or implied.
3. Prior to impacting any wetlands or proceeding with grading, the applicant shall install
tree preservation fencing and silt fencing and request inspections.
4. Prior to recording the final plat, the applicant shall pay park dedication in lieu of land
dedication, in accordance with the dedication ordinance in effect at the time the final plat is
approved.

5. Prior to recording the final plat, the applicant shall submit the required information and
revise the plans as indicated below consistent with the city code, zoning ordinance and
engineering guidelines as may be applicable:
a. Assessments/easements/agreements/permit requirements:
1) Submit disclosure documents notifying potential buyers about the potential
development of high density housing on the adjacent property.
2) Submit the HOA documents.
3) On the plat, remove outlots A and B and extend the property lines of the adjacent
lot(s) through the wetland.
b. Revise the grading plan to show elevations consistent with the approved grading plan.
c.Revise the street and utility plans as follows:
1) Correct the signature block for the current engineer of record.
2) Indicate all previously constricted utility and street information.
3) Indicate the correct addition for sheets identifying new constriction information.
4) Identify sanitary sewer pipes as follows: 1) between 0-15 feet deep — SDR 35 and 2)
between 15-26 feet deep — SDR 26.
5) Show beginning and end stations at the deflection points in the water main profile.
6) Tie all water main bends with stainless steel tie rods.
7) Indicate the size of water main bends and station. Ninety degree bends are not
permitted.
8) All rip -rap material shall be granite.
9) Add note to indicate all sanitary sewer services shall be four -inch polyvinyl
chloride (PVC) pipe.
10) Insert detail plate ST -10 into the plans to address backyard drain tile and show
clean -outs at the tile ends.
d. Revise the tree preservation plan to identify tree 1014.
6. The trail connection from the southerly cul-de-sac of Yellowstone Lane to the south
property line of Lot 22, Block 2 shall be installed at the same time as the streets and utilities.
7. All disturbed areas shall be restored with sod in front, side and rear yards within 25 feet of
the homes.
8. Standard Conditions:
a. No building permits shall be issued until the final plat, the HOA documents, all
easements, and agreements are filed and recorded with Hennepin County and proof of
recording is submitted to the city.
b. No building permits shall be issued until the wetland buffer and interpretive signs have
been installed.
c. All lowest floor elevations shall be a minimum of two feet higher than the calculated
100 -year high water elevation of adjacent ponds or wetlands. Additionally, the lowest
building opening where storm water may enter (door or window) shall be a minimum of
18 inches higher than the overland overflow.

d. Any signage shall comply with the city's signage regulations.
e. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet
in height.
f. Compliance with the city's tree preservation regulations. Should field adjustments to the
tree preservation fencing result in additional impact, the impact shall require review as
outlined in section 530.19 of the city code.
g. Removal of all hazardous trees from the property at the owner's expense.
h. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat or unless the landowner or applicant has received
prior approval from the city to extend the expiration date for up to one additional year, as
regulated under section 512 of the city code.
