HomeMy WebLinkAboutCity Council Resolution 2011-081CITY OF PLYMOUTH RESOLUTION No. 2011-081 A RESOLUTION AUTHORIZING THE VACATION OF DRAINAGE, UTILITY AND ROAD EASEMENTS WITHIN THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 4-118-22 WHEREAS, a public hearing with respect to said vacation was scheduled for March 8, 2011 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of March 8, 2011; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on March 8, 2011 to inform any and all interested parties relevant to the vacation of drainage, utility and road easements within the Southwest quarter of the Northeast quarter of Section 4-118-22; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That said drainage, utility and road easements within the Southwest quarter of the Northeast quarter of Section 4-118-22, as described in Document No. 4046653, 4664163 and 4664164, be vacated: 1. Except part of an easement for road purposes over and across the easterly 33 feet of former PID No. 4-118-22-12-0010, now being part of The Willows Plat, which will be retained until 59th Avenue is constricted within the proposed Trillium Woods Development. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
