HomeMy WebLinkAboutCity Council Resolution 2011-066CITY OF PLYMOUTH RESOLUTION No. 2011-066 A RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT TO CHAPTER 9 (SANITARY SEWER PLAN) TO REVISE SANITARY SEWER DISTRICTS AND DEVELOPMENT STAGING PLAN (2010096) WHEREAS, Gonyea Company has requested a comprehensive plan amendment to revise sanitary sewer districts and the development staging plan for property located at the northeast and southest corners of County Road 47 and Dunkirk Lane and properties east of Dunkirk Lane, legally described as follows: PID: 05-118-22-13-0003 All of the Northeast 1/4 of Section 5, Township 118, Range 22, lying Westerly of the West line of the East 5/8 of the Northeast 1/4 of Section 5, Township 118, Range 22, and lying Southerly of the Right of way of County Road 47, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. Resolution 2011-066 (2010096) Page 5 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve amendments to Chapter 9 of the Comprehensive Plan to revise sanitary sewer districts (re-routing sewer from west to north and east) and the development staging plan (from stage D to A.1), based on the finding that the amendment would allow development from east to west in a contiguous fashion. FURTHER, to incorporate the changes, the city will modify the following figures and tables in chapter 9 of the comprehensive plan. 1. Figure 9-2, Development Staging Plan. 2. Figure 9-3, 2030 Sanitary Sewer Plan. 3. Table 9A-1, Land Use Flow Rates by Sub -District FURTHER, the comprehensive plan amendment is effective January 1, 2012 for all affected properties, except 05-118-22-43-0002 (excluding approximately four acres around the existing home in the northwest corner) and 05-118-22-43-0004, for which it is effective immediately. FURTHER, approval of the comprehensive plan amendment is contingent upon, and subject to, approval of an amended sanitary sewer service agreement between the City of Plymouth and City of Maple Grove. FURTHER, approval of the comprehensive plan amendment is contingent upon, and subject to, the required review and response by the Metropolitan Council. APPROVED THIS 22N DAY OF FEBRUARY, 2011.
