HomeMy WebLinkAboutCity Council Resolution 2011-055CITY OF PLYMOUTH RESOLUTION No. 2011-055 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR PULTE HOMES FOR "THE WILLOWS SECOND ADDITION" FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF JUNEAU LANE AND COUNTY ROAD 47 (201 1003) WHEREAS, Pulte Homes of Minnesota has requested approval of a final plat and development contract for the roughly 9.3 acres of land presently legally described as follows: Outlot D, The Willows, Hennepin County, Minnesota WHEREAS, the city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pulte Home of Minnesota for a final plat for The Willows Second Addition; and, FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development on behalf of the city; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat; 1. A final plat is approved for the creation of 22 single-family lots for The Willows Second Addition, in accordance with the plat and plans received by the city on January 10, 13 and 14, 2011, except as may be amended by this resolution. 2. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances are approved or implied. 3. Prior to proceeding with 2radin2 or development activity, the applicant shall install tree preservation fencing and silt fencing and request inspections. 4. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. 5. Prior to recording the final plat, the applicant shall pay park dedication in lieu of land dedication, in accordance with the dedication ordinance in effect at the time the final plat is recorded. Prior to recording the final plat, the applicant shall submit the required information and revise the plans as indicated below consistent with the city code, zoning ordinance and engineering guidelines as may be applicable: a. Assessments/easements/agreements/permit requirements: 1) Pay the following area assessments: a) sanitary sewer in the amount of $8,920.34 and b) water in the amount of $33,102.97. 2) Submit a trail easement over the trail segment connecting 59th Avenue and the Northwest Greenway trail corridor between lots 5 and 6, Block 1. 3) Dedicate Juneau Lane right-of-way south of 59th Avenue with 22.43 feet of right- of-way from the existing centerline. The easterly plat boundary shall be tied to the center line of the traveled roadway for Juneau Lane. 4) Execute an encroachment agreement for retaining walls that cross into drainage and utility easements on Lots 2 and 5-10, Block 1 and Lots 2-4, Block 3. The applicant shall minimize the walls in the drainage and utility easements to the extent possible. 5) Execute a maintenance agreement for the rain garden. 6) Submit disclosure documents notifying potential buyers about the city's intent to close Juneau Lane when Cheshire Parkway is extended to County Road 47 and that the property to the east is proposed to be developed with the Trillium Woods project. 7) Submit the HOA documents. 8) Show the locations of the final drainage and utility easement on the plat over Lots 1-4, Block 3 after the existing easements have been vacated. A 10 -foot drainage and utility easement must be provided along the north property line of Lot 4, Block 9) Vacate the following easements: a. The 43 -foot wide drainage and utility easement shown adjacent to Juneau Lane. b. The 27 -foot wide street and utility easement on property previously identified as 04-118-22-13-0010. c. The 6 -foot and 10 -foot drainage and utility easements on property previously identified as 04-118-22-13-0010. d. The southerly 550.45 feet of the 33 -foot street easement shown adjacent to Juneau Lane. 10) Permits as follows: MPCA (for sanitary sewer expansion), Department of Health (watermain extension and well abandonment), Elm Creek Watershed District, NPDES, Hennepin County (abandonment of on-site sewage system), and City of Plymouth (right-of-way). b. Revise the grading, water resources plan, and erosion control plan to: 1) Darken the symbol for the wetland buffer monuments. 2) Add buffer monuments at the Juneau Lane right-of-way. 3) Consider applying for a LOMR or LOMA to alter the floodmap for the lots affected by the special flood hazard zone A designation (Block 1). 4) Show location of concrete trick washout station and include a detail. Res. 2011-055 File 2011003 Page 3 5) Show the maintenance access for the rain garden and the sanitary sewer manholes outside street rights-of-way. The access must be 15 feet wide and have a slope of less than 10 percent with a 12 -foot wide driving surface capable of supporting maintenance equipment. 6) Provide a 12 -foot by 20 -foot gravel or reinforced turf hammer -head turn approximately 20 feet north of the existing sewer manhole previously installed in the southeast corner of the plat. 7) Indicate rip -rap on the end of flared end section of pond outlet pipe. c.Revise the street and utility plans as follows: 1) Revise hydrant spacing as needed along Kingsview Lane and 59th Avenue to provide a maximum spacing of 400 feet (as the hose lays). 2) Add a note to remove the plug where it connects to the existing 18 -inch storm sewer stub on 59th Avenue and where it connects to the 15 -inch storm sewer stub in the rain garden. 3) Extend an eight -inch water main stub to the east side of Juneau Lane at 59t1' Avenue and extend an eight -inch water main south from 59t1' Avenue along Juneau Lane to the south plat boundary. The water main may be installed along the east side of the street. 4) Change note 4 of the utility notes to read "water" instead of "copper" services. 5) Add note on sheet 8 as follows: "The sanitary sewer from manhole 10 to manhole 17 was constricted with the first addition." 6) Relocate the sidewalk to the south side of 59t1' Avenue between Kingsview Lane and Juneau Lane to avoid a conflict with the catch basin. 7) Add a storm sewer manhole at the intersection of 59th Avenue between catch basin manhole 116 and catch basin 114 and connect the stricture to catch basin 115. 8) Install a street light in the northwest corner of 59t1' Avenue and Juneau Lane. 9) Provide 20 mile per hour advisory speed signs and curve arrows in advance of the street curve in the vicinity of station 43+00 on 59t1' Avenue. 10) Add a note "C/L Kingsview Lane" in the centerline profile at station 46+60.08 for 59th Avenue. 11) Indicate the well is to be abandoned. 12) Add a catch basin in the southwest corner of the intersection of Juneau Lane and 59th Avenue. d. Revise the landscaping plan as follows: 1) Add the wetland buffers and buffer monuments to the landscaping plan. 2) Relocate trees outside of wetland buffers. 3) Remove the fence shown within the wetland buffer. 7. Prior to the issuance of any building permits: a. The home at 5835 Juneau Lane shall be connected to city sewer and water. b. Wetland buffer and wetland interpretive signs shall be installed. Res. 2011-055 File 2011003 Page 4 8. The sidewalks along all local streets and the trail shall be installed at the same time as the streets and utilities. 9. No driveway access shall be permitted to County Road 47 or Juneau Lane, except that 5835 Juneau Lane (Lot 1, Block 3, The Willows) may have driveway access to Juneau Lane. 10. All lowest floor elevations shall be a minimum of two feet higher than the calculated 100 - year high water elevation of adjacent ponds or wetlands. Additionally, the lowest building opening where storm water may enter (door or window) shall be a minimum of 18 inches higher than the overland overflow. 11. Standard Conditions: a. No building permits shall be issued until the final plat, the HOA documents, all easements, and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall comply with the city's signage regulations. c. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. d. Compliance with the city's tree preservation regulations. Should field adjustments to the tree preservation fencing result in additional impact, the impact shall require review as outlined in section 530.19 of the city code. e. Removal of all hazardous trees from the property at the owner's expense. f. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat with Hennepin County, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
