RESOLUTION No. 2011-017
APPROVING RELEASE OF COVENANT FOR THE FORMER
HAMPTON HILLS GOLF COURSE SITE (2010043)
WHEREAS, in 1994 the ownership of the former Hampton Hills Golf Course property
entered into a covenant—recorded as Document No. 2471818—stating that they, their successors
and assigns would not petition to the city for a division of a caretakers residence (to be
constricted on the golf course site at that time) from the golf course property; and
WHEREAS, the legal description of the subject property is the Southeast Quarter of the
Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota; and
WHEREAS, the covenant states that in the event of change in city ordinances as
applicable to the subject property, or in the event sewer and water are available to the subject
property, the owner reserves the right to petition to the city for a division; and
WHEREAS, the covenant states that the city shall have the right to dismiss and release
this covenant by executing a Release of Covenant that references said covenant; and
WHEREAS, the subject property was added to the urban service area in 2008 and was
rezoned to RSF-2 (single family detached 2) in 2010; and
and
WHEREAS, public sewer and water are presently available and the site can be developed;
WHEREAS, the city finds that there is no longer any need to maintain the covenant.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does release the covenant
recorded in the office of the Registrar of Titles in and for Hennepin County, Minnesota as
Document No. 2471818. Further, the Mayor and City Manager are hereby authorized to sign the
Release of Covenant.
