RESOLUTION NO. 99-543
AUTHORIZING THE VACATION OF
POLARIS LANE NORTH RIGHT-OF-WAY AND
PART OF 51sT AVENUE NORTH STREET RIGHT-OF-WAY
SILVERTHORNE 4TH ADDITION
WHEREAS, the City Council by its own motion proposed the vacation of Polaris Lane North Right -
of -Way and Part of 51st Avenue North Street Right -of -Way; and
WHEREAS, a public hearing with respect to said vacation was scheduled for December 21, 1999 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of December 21, 1999; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, Reliant Energy Minnesgasco submitted a letter dated December 7, 1999 requesting the
City to reserve an easement along the south half of 51st Avenue and all of Polaris Lane unless the
petitioner agrees to reimburse them the cost of relocating and /or abandoning the existing gas main;
and
WHEREAS, the City attorney has indicated the City has no obligation to retain any existing drainage
and utility easements on behalf of the utility companies; and
WHEREAS, the Council did hold a public hearing on December 21, 1999 to inform any and all
interested parties relevant to the vacation of Polaris Lane North Right -of -Way and Part of 51st Avenue
North Street Right -of -Way and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following Polaris Lane North Right -of -Way and Part of 51st
Avenue North Street Right -of -Way be vacated:
All of Polaris Lane North, as dedicated in the plat of Silverthorne 4th Addition,
according to the recorded plat thereof and situate in Hennepin County, Minnesota, and
that part of 51st Avenue North, as dedicated in said Silverthorne 4th Addition lying
easterly of the northeasterly extension of the westerly line of Lot 4, Block 4, said
Silverthorne 4th Addition.
Adopted by the City Council on December 21, 1999.
