HomeMy WebLinkAboutCity Council Resolution 1999-542CITY OF PLYMOUTH RESOLUTION NO. 99-542 AUTHORIZING THE VACATION OF PART OF THE DRAINAGE AND UTILITY EASEMENTS WITHIN SILVERTHORNE 4TH ADDITION WHEREAS, a petition was received to vacate part of the drainage and utility easements within Silverthorne 4th Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for December 21, 1999 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 21, 1999; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, Reliant Energy Minnesgasco submitted a letter dated December 7, 1999 requesting the City to reserve an easement along the south half of 51st Avenue and all of Polaris Lane unless the petitioner agrees to reimburse them the cost of relocating and /or abandoning the existing gas main; and WHEREAS, the City attorney has indicated the City has no obligation to retain any existing drainage and utility easements on behalf of the utility companies; and WHEREAS, the Council did hold a public hearing on December 21, 1999 to inform any and all interested parties relevant to the vacation of part of the drainage and utility easements within Silverthorne 4th Addition; and C:ADoc=cnts and Settingsubaird\Local Settings\Temp\CCR 1999-542_59741\CCR 1999-542.doc WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated: The easements for drainage and utility purposes, as dedicated in the plat of Silverthorne 4th Addition, according to the recorded plat thereof and situate in Hennepin County, Minnesota described as follows: Block 4, said Silverthorne 4th Addition. Except the westerly 10.00 feet thereof, and except the south 10.00 feet of Lots 1, 7, 8, and 9, said Block 4. And Lots 3, 4, 5, 6 and 7, Block 3, said Silverthorne 4th Addition. Except that part dedicated along the westerly and northerly lines of said Lot 3, and except that part along the northwesterly lines of said Lots 4, 5, 6 and 7. And A strip of land 20.00 feet in width as dedicated over that part of Outlot B, said Silverthorne 4th Addition. The centerline of said strip is described as commencing at the most southerly corner of Lot 9, Block 4, said Silverthorne 4th Addition; thence North 14 degrees 46 minutes 15 seconds West assumed bearing along the east line of said Lot 9 a distance of 136.15 feet to the point of beginning of the centerline to be described; thence South 61 degrees 42 minutes 47 seconds East a distance of 215.00 feet; thence South 44 degrees 41 minutes 18 seconds East a distance of 116.00 feet to the south line of said Outlot B and said centerline there terminating.
