RESOLUTION 99-525
APPROVING AN AMENDMENT TO THE SITE PLAN AND CONDITIONAL USE PERMIT
FOR TSP ONE INC. FOR WAYZATA SCHOOLS CENTRAL SERVICES LOCATED AT
17305 -19TH AVENUE NORTH, AND FOR OAKWOOD ELEMENTARY SCHOOL
LOCATED AT 17340 COUNTY ROAD 6 (99102)
WHEREAS, TSP One, Inc. has requested an amendment to the site plan and conditional use
permit to allow an expansion of the Central Services Building and driveway improvements at
Oakwood Elementary School, for the property legally described as follows:
That part of the west '/2 of the southwest 1/4 of Section 29, Township 118, Range 22,
described as follows: Beginning at a point in the east line of the west '/z of said southwest
1/4 distant 410.00 feet south of the northeast corner thereof, thence south along said east
line 1282.56 feet to the centerline of County Road 6; thence westerly deflecting to the right
at an angle of 95 degrees 35 minutes along centerline a distance of 100.48 feet; thence
north parallel with the east line of the west '/2 of said southwest 1/4, a distance of 326.85
feet; thence at a right angle west 425 feet; thence at a right angle south 293 feet to the
centerline of said County Road 6; thence deflecting to the right at an angle of 93 degrees
59 minutes along said centerline, a distance on 809.67 feet to the west line of said section;
thence north along the west line of said section 1414.52 feet to a point therein distant
143.82 feet south of the northwest corner of said southwest 1/4; thence easterly deflecting to
the right at an angle of 77 degrees 22 minutes a distance of 419.53 feet to an intersection
with a line parallel with and 66 feet south of the north line of said southwest 1/4; thence east
along said parallel line to a point 105 feet west of the east line of the west '/2 of said
southwest 1/4; thence south parallel with the east line of the west '/2 of the southwest 1/4 a
distance of 344 feet; thence east parallel with the north line of said southwest 1/4 a distance
of 105 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by TSP
One Inc. for an amendment to the site plan and conditional use permit to allow an expansion of
the Central Services Building and driveway improvements at Oakwood Elementary School,
subject to the following conditions:
1. The amendment to the site plan and conditional use permit allows construction of a 3,380
square foot vehicle -storage addition and a 528 square foot office addition to the Central
Services Building, as well as driveway improvements at Oakwood Elementary School, as
shown on the revised plans received by the City on November 24, 1999, except as amended
by this resolution.
2. The conditional use permit standards are met for the building expansion and driveway
improvements, as follows:
a. The Central Services Building and the Oakwood Elementary School are allowable uses in
the RSF-1 zoning district and would, therefore, be consistent with the Comprehensive
Plan.
b. Approval of the amended conditional use permit for the building expansion and driveway
improvements would not be detrimental to the public health, safety, morals, or comfort,
because all the applicable Zoning Ordinance standards would be met.
c. The building expansion and driveway improvements would not be injurious to the
immediately surrounding properties. All minimum building and parking setbacks specified
under the Zoning Ordinance would be met.
d. The surrounding properties are developed and the building expansion and driveway
improvements would not impede improvement of the surrounding properties.
e. The proposed site plan meets all setback, height, and coverage regulations of the RSF-1
zoning district. Additionally, the proposed building expansion and driveway
improvements would meet all the requirements of the shoreland overlay district.
f. The proposed building expansion and driveway improvements comply with all the
performance standards outlined in the Zoning Ordinance.
3. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
c. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
d. Compliance with the Ordinance regarding the location of fire lanes and fire lane signage.
e. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation. The proposed building addition and driveway
improvements are consistent with all the performance standards outlined in the Zoning
Ordinance.

f. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started construction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning
Ordinance.
