HomeMy WebLinkAboutCity Council Resolution 1999-524CITY OF PLYMOUTH RESOLUTION 99-524 APPROVING A SITE PLAN AMENDMENT FOR TOLL GAS AND WELDING SUPPLY TO LOCATE A PROPYLENE TANK AT 3005 NIAGARA LANE NORTH (99120) WHEREAS, Thermogas Company has requested a site plan amendment to locate a 3,000 - gallon propylene tank on property legally described as follows: Lot 4, Block 1, Playhouse Industrial Park 2nd Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Thermogas Company for a site plan amendment, subject to the following conditions: 1. The site plan amendment is for a 3,000 gallon propylene tank, as shown on plans received on November 1, 1999, except as amended by this resolution. 2. A building permit is required prior to beginning locating the tank and equipment on the property. 3. The tank shall be installed and protected to fire code requirements. 4. Prior to issuance of a tank permit, the applicant shall demonstrate compliance with any required EPA Risk Management and OSHA Process Management safety regulations. 5. Approval of the site plan amendment does not abrogate the need for the applicant to obtain all required federal, state, and local permits or approvals. Resolution 99-524 (99120) Page 2 of 2 6. Standard Conditions: a) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b) Compliance with the City Code regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. c) This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
