HomeMy WebLinkAboutCity Council Resolution 1999-498CITY OF PLYMOUTH RESOLUTION 99-498 APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR HENNEPIN PARKS FOR EAGLE LAKE REGIONAL PARK LOCATED NORTH OF THE "T" INTERSECTION OF BASS LAKE ROAD AND ZACHARY LANE (99100) WHEREAS, Hennepin Parks has requested approval of a site plan and conditional use permit to allow development of a recreation area, including golf facilities, for property legally described as follows: Outlot A, Bass Creek Business Park. Also, Government Lot 2, Section 1, Township 118, Range 22. Also, the southwest quarter of the northwest quarter of Section 1, Township 118, Range 22. Also, Government Lot 2, Section 2, Township 118, Range 22. All of the above lying in Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hennepin Parks for a site plan and conditional use permit to allow development of a recreation area, including golf facilities, for property located north of the "T" intersection of Bass Lake Road and Zachary Lane, based on the following findings: 1. Comprehensive Plan: The subject site is guided P -I. The Comprehensive Plan states that "Public/Semi-Public/Institutional' includes public and semi-public facilities such as places of worship, parks, community playfields, and other recreation facilities. Also included in the P -I classification are public service facilities such as post offices, fire stations, libraries, utility Resolution 99-498 (99100) Page 2 of 4 structures, schools, public administrative offices and maintenance shops, and similar uses. Consequently, use of the subject site for an active recreation area, including the golf facilities, is consistent with the P -I guiding of the property. 2. Public Welfare: The proposed golf facilities would not be detrimental to or endanger the public health, safety, or comfort, because the golf facilities would comply with all applicable ordinance requirements, with the exception of the request to extend the hours of operation. The proposed golf facilities, along with the trails, cross-country ski trails, and other recreational facilities, would provide recreation opportunities for Plymouth residents and citizens of the metropolitan area. 3. Impact on Surrounding Property: With the exception of the variance to allow extended hours of operation, the golf facilities would comply with all the applicable performance standards of the City Code, including the Zoning Ordinance. Further, Hennepin Parks is proposing to plant a dense row of trees and shrubs along the perimeter of the site to screen the course from adjacent properties. Golf courses are typically located in or near residential areas, including Hollydale golf course and the proposed Begin Oaks course in the City of Plymouth. The City Assessor indicated that while the City has not conducted a formal study, there is a positive effect on property values of homes located in proximity to golf courses. 4. Orderly Development: The land to the north is park land owned by Hennepin Parks. Consequently, the proposed golf facilities would not impede any improvements to that property. The land to the east is a large office/industrial park that is nearly fully developed. A golf course on the subject property would not impact the orderly development of the industrial park. To the south of the site is Bass Lake Road. South of Bass Lake Road is land developed with townhomes. To buffer these homes from Bass Lake Road, the developer of the townhome units constructed berms and planted landscaping to create both a visual and noise buffer. These berms and plantings would also buffer the homes from activity associated with the proposed golf course facilities. Consequently, the golf facilities would not impede the orderly development of this property. The land to the west is being developed with townhomes. These units would be buffered by existing trees on the townhome property as well as by proposed landscaping on the golf course property. Further, the buildings and parking areas would be screened from view. 5. Public Facilities: Adequate sewer, water and roads are currently in place to serve the proposed facility. Resolution 99-498 (99100) Page 3 of 4 The traffic study prepared as part of the EAW for the proposed development indicates that traffic to and from the golf course would not adversely affect traffic operations in the vicinity of the site. 6. District Regulations: The proposed golf course would comply with the development regulations in the P -I zoning district. 7. Performance Standards: As discussed in the analysis of the site plan, the plans for the proposed golf course comply with all the applicable performance standards. FURTHER, BE IT HEREBY RESOLVED, that the site plan and conditional use permit allow development of a recreation area, pursuant to the plans received by the City on September 24, 1999, and October 15, 1999, subject to the following conditions: 1. A grading permit is required prior to commencing construction. 2. Prior to the issuance of building permits, the Planning Division shall verify that the lighting used on site is equivalent or superior to the lighting fixtures included in the application received September 24, 1999. 3. This resolution approves a Fire Code Variance to the requirement for a fire lane within 50 feet of all sides of the visitor center, maintenance and cold storage buildings. 4. Signage for this site shall be in compliance with the Sign Ordinance. 5. All drive aisles must be constructed to fire lane standards. 6. The locations of fire hydrants must be approved by the Fire Inspector. 7. If there is a documented parking shortage or the overflow parking is used on a regular basis, the applicant shall request a site plan amendment to pave the overflow parking. 8. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Prior to issuance of building permits, submission of the required Financial Guarantee and Site Performance Agreement for all exterior improvements excluding landscaping. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. Compliance with the Ordinance regarding the location of fire lanes and fire lane signage. Resolution 99-498 (99100) Page 4 of 4 f. The conditional use permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance ADOPTED by the City Council on November 16, 1999.
