RESOLUTION 99-483
APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR FLESNER
ADDITION FOR MATTHEW D. FLESNER AND THEODORE W. FLESNER FOR
PROPERTY LOCATED AT 16220 OLD ROCKFORD ROAD (98162F)
WHEREAS, Matthew D. Flesner and Theodore W. Flesner have requested final plat approval for
Flesner Addition, a plat of two single family lots on a 2.4 -acre parcel located at 16220 Old
Rockford Road; and
WHEREAS, the subject property is legally described as follows:
That part of the east 1/2 of the northeast 1/4 section 17-118-22 bounded by a line beginning at the
northwest corner of the southeast'/4 of the northeast'/4 of Section 17; thence north along the west
line of said east '/z of the northeast'/4 264 feet; thence east at right angles 330 feet; thence south at
right angles 446.8 feet more or less to the center line of State Highway No. 55 (so called); thence
northwesterly along the center line of said Highway No. 55 369.65 feet more or less to the west
line of the east '/z of the northeast 1/4 of said Section 17; thence north 16.6 feet more or less to the
point of beginning containing about 2.75 acres and excepting therefrom that part taken for road
purposes, Hennepin County, Minnesota.
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for
Flesner Addition; and,
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:

1. Final plat approval is hereby granted for Flesner Addition in accordance with the plans
received by the City on September 27, 1999, except as amended by this resolution.
2. The plat is subject to the RSF-2 district standards, except as amended by this resolution.
3. Lot 1 and Lot 2 shall share a driveway access at the common lot line. The shared driveway
agreements must be approved by City staff and recorded at Hennepin County prior to
recording the final plat.
4. This plat is subject to all Wetland Ordinance standards.
5. Prior to final grading inspection, wetland buffer monuments shall be installed in accordance
with Section 21670.07 of the Zoning Ordinance.
6. Uncovered decks and patios may encroach up to six feet into the required wetland setback
pursuant to Section 21670.09 of the Zoning Ordinance.
7. A permit from the Metropolitan Council Environmental Services (MCES) is required prior to
connecting to the sanitary sewer in Old Rockford Road.
8. The permit for connecting to the MCES sanitary sewer must be picked up from the City
Engineer. The MCES requires an inspection of the connection to the sewer, therefore, the
MCES must be contacted and arrangements must be made for inspection. The sewer service
may need to be re -excavated for inspection. The cost is the responsibility of the property
owner.
9. The plat is subject to all Floodplain Overlay District standards, except as amended by
Resolution 98-689.
10. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
11. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
d. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements. The Site Improvement Performance Agreement shall
include, but not be limited to, the required wetland buffer monumentation.
e. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.

f. Park dedication fees shall be cash fees -in -lieu of land dedication in accordance with the
dedication policy in effect at the time the final plat is recorded. This fee shall be paid prior
to release of the final plat mylars.
g. Addresses shall comply with the street addressing system.
