HomeMy WebLinkAboutCity Council Resolution 1999-462CITY OF PLYMOUTH RESOLUTION 99 - 462 AMENDING RESOLUTION 98-731 FOR SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND INTERIM USE PERMIT AND RESOLUTION 98-732 FOR LOT DIVISION/LOT CONSOLIDATION FOR CARLSON REAL ESTATE COMPANY FOR COUNTRY INNS & SUITES LOCATED AT 210 CARLSON PARKWAY TO AMEND CONDITIONS RELATING TO EASEMENTS (98179-2) WHEREAS, Carlson Real Estate Company has requested approval of a site plan amendment, conditional use permit amendment, interim use permit and lot division/lot consolidation for property legally described as follows: PARCEL 1 That part of Lot 1, Block 1, Carlson Center 15th Addition lying south of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes 35 seconds west a distance of 213.19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. PARCEL 2 Lots 2 and 3, Block 1, Carlson Center 12th Addition. That part of Lot 1, Block 1, Carlson Center 15th Addition lying north of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes Resolution 99-462 Page 2 35 seconds west a distance of 213.19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. WHEREAS, the City Council approved a site plan amendment, conditional use permit amendment and interim use permit for Carlson Real Estate Company under Resolution 98- 731 on December 16, 1998; and WHEREAS, condition no. 2(b) of Resolution 98-731 stated as follows: "Covenants regarding cross access and fire access shall be submitted for staff review and approval and shall be filed with Hennepin County prior to issuance of building permits"; and WHEREAS, Carlson Real Estate Company has requested that the condition no. 2(b) be amended so that they may begin construction prior to filing the easement documents. WHEREAS, the City Council approved a lot division/lot consolidation for Carlson Real Estate Company under Resolution 98-732 on December 16, 1998; and WHEREAS, condition no. 3 of Resolution 98-732 stated as follows: "Submittal of required drainage and utility easement documents as approved by the City Engineer prior to filing of the lot division/lot consolidation"; and WHEREAS, Carlson Real Estate Company has requested that the condition no. 3 be amended so that they may begin construction prior to filing the easement documents. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does amend the resolution for a site plan amendment, conditional use permit amendment and interim use permit for Carlson Real Estate Company by amending condition no. 2(b) of Resolution 98-731 and condition no. 3 of Resolution 98-732 as follows: Resolution 98-731 2. The interim use permit allows shared parking between the subject property and the Two Carlson Parkway office building, in accordance with the plans received by the City on October 2, 1998 and November 3, 1998, except as amended by this resolution. a. The interim use permit is to allow joint use of up to 26 required parking stalls between Country Inns & Suites, Italianni's restaurant and Two Carlson Parkway office building. b. Covenants regarding cross access and fire access shall be submitted for staff review and approval and shall be filed with Hennepin County prior to issuance of a Certificate of Occupancy. The interim use permit shall terminate if any of the following events occur: (1) The use of any of the buildings changes to a use that increases the need for parking spaces. (2) City staff documents a parking problem associated with inadequate parking. (3) The floor area of the building is increased in size. Resolution 98-732 3. Required drainage and utility easement documents as approved by the City Engineer shall be filed at Hennepin County prior to issuance of a Certificate of Occupancy.
