RESOLUTION NO. 99-455
ORDERING IMPROVEMENT AND PREPARATION OF
PLANS AND SPECIFICATIONS
SANITARY SEWER SERVICE
TROY LANE NORTH OF COUNTY ROAD 6
CITY PROJECT NO. 7018
WHEREAS, Resolution No. 99-401 of the City Council adopted the 21" day of
September, 1999, fixed a date for a public hearing with respect to the extension of sanitary
sewer to serve properties north of County Road 6 near Troy Lane; and
WHEREAS, the proposed project includes the construction of new sanitary sewer and all
necessary appurtenances; and
WHEREAS, Resolution No. 99-401 of the City Council adopted the 21st day of
September, 1999, also accepted the preliminary engineering report which concluded that
the proposed project is feasible, necessary and cost effective; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held thereon the 19th day of October,
1999, at which time all persons desiring to be heard were given an opportunity to be heard
thereon; and
WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes)
since the project has not been petitioned for by the benefiting owners
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. Such improvement is hereby ordered for the North Subarea as
proposed in the Council resolution adopted September 21, 1999.
2. Improvement is hereby ordered to serve 4 lots in the Southeast Subarea
as discussed in the preliminary engineering report (18200 and 18220
County Road 6 and 1525, 1550 Troy Lane). 1615 Troy Lane will be
added to the project if they sign a waiver of public improvement
hearing.
3. The Plymouth Engineering Department is designated as engineer for
the improvement. They shall prepare plans and specifications for the
making of such improvement.
