HomeMy WebLinkAboutCity Council Resolution 1999-429CITY OF PLYMOUTH RESOLUTION NO. 99-429 AUTHORIZING THE VACATION OF PART OF A DRAINAGE EASEMENT FOR PONDING LOTS 1 AND 3, BLOCK 1 MEYER GONYEA ADDITION WHEREAS, a petition was received to vacate part of a drainage easement for ponding in Lots 1 and 3, Block 1, Meyer Gonyea Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for October 5, 1999 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 5, 1999; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on October 5, 1999 to inform any and all interested parties relevant to the vacation of part of a drainage easement for ponding in Lots 1 and 3, Block 1, Meyer Gonyea Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage easement for ponding be vacated: Those parts of Lots 1 and 3, Block 1, Meyer Gonyea Addition, according to the recorded plat, lying easterly of a line drawn parallel with and distant 44.00 feet west of C:ADoc=cnts and Settingsubaird\Local Settings\Temp\CCR 1999-429_59625\CCR 1999-429.doc the east line of said Lot 1 and its southerly extension and lying south of the north line of the South 120 feet of said Lot 1, except the south 10.00 feet of said Lot 3. Adopted by the City Council on October 5, 1999. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on October 5, 1999, with the original thereof on file in my office, and the same is a correct transcription thereof.
