FOR SUNSET HILL ELEMENTARY SCHOOL LOCATED AT 13005 SUNSET TRAIL (99085) WHEREAS, TSP One, Inc. has requested a site plan amendment and conditional use permit amendment to allow an addition to the school and related site improvements at 13005 Sunset Trail, legally described as follows: That part of the southeast quarter of the southeast quarter of Section 34, Township 118 North, Range 22 West, of the 5th Principal Meridian, lying west of the east 272.22 feet thereof and lying south of the southerly line of County Road No. 15. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by TSP One Inc. for a site plan amendment and conditional use permit amendment to allow an addition to the school and related site improvements at 13005 Sunset Trail, subject to the following conditions: 1. The site plan amendment and conditional use permit amendment allow construction of a building addition and related site improvements, as shown on plans received by the City on August 13, 1999, except as amended by this resolution. 2. The conditional use permit standards are met for the building addition and related improvements, as follows: a. The proposed use would comply with the Comprehensive Plan, including the City's policies for wetland protection. Resolution 99-418 (99085) Page 2 of 3 b. The proposed use would promote and enhance the general public welfare and would not be detrimental to or endanger the public health, safety, morals or comfort. The building and parking lot expansions would not create a safety hazard on the adjacent public street. c. The building additions would not be injurious to the use and enjoyment of other property in the immediate vicinity, because the proposed improvements would be over 100 feet from the nearest property line. d. The proposed use would not impede the normal and orderly development and improvement of surrounding property for uses permitted in the RSF-1 zoning district. e. The proposed school building additions would have no effect on public facilities or services. f. The proposed use would comply with the regulations of the RSF-1 zoning district. g. The proposed school building additions would comply with the performance standards of the Zoning Ordinance. 3. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
