HomeMy WebLinkAboutCity Council Resolution 1999-416ACITY OF PLYMOUTH RESOLUTION 99-416A REQUESTING THAT PARCEL 03-118-22-24-0073 BE WITHHELD FROM AUCTION IN ACCORDANCE WITH M.S. 282.01 FOR A PERIOD NOT TO EXCEED ONE YEAR WHEREAS, Hennepin County has provided the City of Plymouth with a list of nonconservation properties which have become tax forfeit as a result of nonpayment of property taxes and/or special assessments; and WHEREAS, in accordance with the City Council Tax Forfeit Land policy, each parcel has been reviewed by staff, and WHEREAS, parcel 03-118-22-24-0073 contains the storm water treatment ponds and screening for the Camelot Overlook subdivision; and WHEREAS, the development contract for this subdivision states that ownership of the outlot was to be conveyed to the homeowners' association and the homeowners' document also indicates that they were to receive title to this outlot; and WHEREAS, it appears that the ownership of this property was never properly transferred from the developer to the homeowners association. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Plymouth, Minnesota, that it hereby: 1. Approves the classification made by the Hennepin County Board of Commissioners of parcel 03-118-22-24-0073 as nonconservation land. A review of public waterfront, wetland, peat, and timber issues has been done and no public nuisance conditions were noted on the parcel. The City Council certifies that it does not know of any wells located on the property; 2. Requests that parcel 03-118-22-24-0073 be withheld from auction in accordance with M.S. 282.01 for a time period not to exceed one year. This request is made in order that the City Attorney can follow up on why the parcel was not correctly conveyed to the homeowners' association and attempt to resolve the issue; and 3. Verifies the amount of $198.30 in special assessments against this parcel before forfeiture. Adopted by the City Council on October 5, 1999.
