HomeMy WebLinkAboutCity Council Resolution 1999-402RESOLUTION NO. 99-402 REIMBURSING DEVELOPER FOR REQUIRED SANITARY SEWER CONSTRUCTION WESTBRANCH 4TH ADDITION (95139) WHEREAS, the City of Plymouth and U.S. Home Corporation, have entered into a development contract dated October 8, 1997, for the development Westbranch 4th Addition (95139); and WHEREAS, as part of this development, the developer agreed to construct sanitary sewer improvements in Westbranch 4th Addition in order to conform with the City of Plymouth's overall Sanitary Sewer Plan; and WHEREAS, the developer installed the required sanitary sewer at the required elevations; and WHEREAS, the work has been completed as detailed in the approved plans and specifications; and WHEREAS, the City of Plymouth has previously accepted the utilities, including the sanitary sewer, for continual maintenance; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for the cost of unusual sanitary sewer construction upon completion in accordance with the approved plans and specifications and acceptance for continual maintenance by the City; and WHEREAS, this amounts to $30,803.90, based on the actual construction costs and including engineering fees. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: that the developer, U.S. Home Corporation, is to be reimbursed by the City of Plymouth in the amount of $30,803.90 for the required sanitary sewer construction based on the alignment and the approved construction plans. BE IT FURTHER RESOLVED that the funds be allocated from the Trunk Sewer Fund. Adopted by the City Council on September 21, 1999.
