HomeMy WebLinkAboutCity Council Resolution 1999-380CITY OF PLYMOUTH RESOLUTION 99-380 CORRECTING RESOLUTION 99-244 ( DOC. #7140430) AUTHORIZING THE VACATION OF PART OF BROCKTON LANE STREET RIGHT-OF-WAY GREENTREE WEST WHEREAS, a petition was received to vacate part of Brockton Lane street right-of-way in Greentree West; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for May 18, 1999 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of May 18, 1999; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on May 18, 1999 to inform any and all interested parties relevant to the vacation of part of Brockton Lane street right-of-way in Greentree West Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; WHEREAS, the City Council adopted Resolution No. 99-244 vacating said right of way but the Hennepin County Surveyor's office has requested that the description of said vacation be clarified by defining the centerline as the section line. C:ADoc=cnts and Settingsubaird\Local Settings\Temp\CCR 1999-380_59575\CCR 1999-380.doc Resolution 99-380 Page 2 of 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following part of Brockton Lane street right-of-way in Greentree West be vacated: That part of Brockton Lane as platted in Greentree West, Hennepin County, Minnesota lying east of a line 25 feet east as measured perpendicular to the west line of the SW 1/4 of Section 19 T. 118 R. 22, also known as the centerline of Brockton Lane; and lying south of the westerly extension of the north line of Lot 8, Block 4, Greentree West and north of the westerly extension of the south line of Lot 10, Block 4, Greentree West. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
