HomeMy WebLinkAboutCity Council Resolution 1999-353CITY OF PLYMOUTH RESOLUTION 99-353 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR LAURENT DEVELOPMENT, INC. FOR "SILVERTHORNE 5TH ADDITION" LOCATED NORTH OF SCHMIDT LAKE ROAD AT QUANTICO LANE (99075-F) WHEREAS, Laurent Development, Inc. has requested approval of a final plat for 13 single family lots as Silverthorne 5th Addition, located north of Schmidt Lake Road at Quantico Lane; and WHEREAS, the property is presently legally described as Outlot B and Outlot F, Silverthorne 4th Addition; and WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Silverthorne 5th Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This approval is for 13 single family lots as Silverthorne 5th Addition, in accordance with the plans received by the City on July 27, 1999, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication in combination with the appropriate credit in an amount determined according to verified dedication acreage, in accordance with the Dedication Policy in effect at the time of filing the final plat with Hennepin County. 3. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance with Section 21670.07 of the Zoning Ordinance for the wetlands located within (or partially Resolution 99-353 (99075-F) Page 2 of 3 within) the final plat area. The monument design shall be approved by the Community Development Department. 4. Development standards shall be specified by the RSF-2 zoning district. No variances are granted or implied. 5. Submission of the required Site Improvement Performance Agreement prior to issuance of building permits. The agreement shall include, but not be limited to, installation of the required landscaping and wetland buffer monument signage. 6. Prior to the issuance of any building permits, the developer shall install the required five-foot wide concrete sidewalk (along the north side of Schmidt Lake Road) from the westernmost line (extended) of Lot 1, Block 3, Silverthorne 5th Addition to the easternmost line (extended) of Lot 9, Block 4, Silverthorne 4th Addition. 7. Prior to filing the final plat, the developer shall submit revised plans indicating the required sidewalk. 8. Notice of the sidewalk and corresponding 10 -foot wide easement shall be included in the development/sales documents so that potential buyers will be aware of the sidewalk. 9. The sidewalk shall not be used for construction access or storage. Any damage done to the sidewalk must be repaired by the developer. 10. The developer shall provide notification and information about the park to the buyers of Lot 1, Block 1 and Lot 1, Block 2, Silverthorne 5th Addition. These two lots abut the access to the future park. 11. Prior to filing the final plat, the developer shall place a sign on Outlot A, Silverthorne 4th Addition to inform people of the future park, parking lot, and park entrance from Quantico Lane. The sign shall include the telephone number of the City's Park and Recreation Division. 12. The Developer shall comply with the City's Tree Preservation Ordinance. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. f. Street names shall comply with the street naming system. g. Private driveway access shall be limited to internal public roads and restricted from Schmidt Lake Road. h. The location and number of fire hydrants shall be approved by the Fire Division. Resolution 99-353 (99075-F) Page 3 of 3 i. Submittal of approved fire flow data prior to the issuance of building permits. j. All lots abutting ponds shall have basement elevations at least two feet above the 100 -year high water elevation. k. Prior to filing the final plat, a maintenance agreement is required between the developer and the City for the water quality ponds. 1. Subsequent phases shall be subject to ordinance provisions for plan and plat applications. m. The developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
