HomeMy WebLinkAboutCity Council Resolution 1999-352CITY OF PLYMOUTH RESOLUTION 99-352 APPROVING CONDITIONAL USE PERMIT FOR MCCARTHY CONSTRUCTION FOR PROPERTY LOCATED AT 9714 -10TH AVENUE NORTH (99074) WHEREAS, McCarthy Construction has requested approval of a conditional use permit to allow up to 94 percent office use at the Banner Engineering facility located in the I-2 district; and, WHEREAS, the property is legally described as follows: Lot 1, Block 1, Banner Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by McCarthy Construction for a conditional use permit to allow 94 percent office use at the facility located at 9714 -10th Avenue North, subject to the following conditions: 1. The conditional use permit allows up to 94 percent office use at the 79,505 square foot Banner Engineering facility located at 9714 -10th Avenue North, in accordance with the application and plans received by the City on July 15, 1999, except as amended by this resolution. 2. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 99-352 (99074) Page 2 c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
