HomeMy WebLinkAboutCity Council Resolution 1999-348CITY OF PLYMOUTH RESOLUTION 99-348 APPROVING CONDITIONAL USE PERMIT AND VARIANCES FOR WAYZATA HIGH SCHOOL STADIUM LOCATED AT 4955 PEONY LANE NORTH (99052) WHEREAS, Armstrong Torseth Skold & Rydeen, Inc. has requested approval of a conditional use permit and variances for the Wayzata High School stadium complex to be located on property legally described as follows: Lots 1, Block 1, Wayzata Senior High School Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval of the conditional use permit and variances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the conditional use permit and variances for the Wayzata High School stadium complex at 4955 Peony Lane North, subject to the following findings and conditions: 1. A conditional use permit is approved to allow an eight -foot high chainlink fence around the stadium complex, in accordance with the plans and application received by the City on June 4, 1999 and revisions received on July 28, 1999, except as amended by this resolution. 2. A variance is approved for the press box to exceed the 20 -foot maximum height permitted for accessory structures, in accordance with the plans and application received by the City on June 4, 1999 and revisions received on July 28, 1999, based on the following findings: a. The physical surroundings of the property create a unique hardship, as distinguished from a mere inconvenience. The press box at the stadium complex must be located at the highest point in the bleachers in order to provide the announcer or broadcaster with an unobstructed view of the entire field. Resolution 99-348 (99052-2) Page 2 of 4 b. The conditions relating to the hardship are not generally applicable to other properties in the P -I zoning district. The student population at the high school requires a stadium that is substantially larger than any other athletic facility in the City. The size of the stadium creates the need for the 34 -foot high press box in order to provide the announcers and broadcasters with an unobstructed view of the field. c. The request is not based exclusively upon a desire to increase value or income potential of the property. The proposed press box would allow the game announcers or broadcasters to see the entire field without difficulty. d. The hardship is caused by the Zoning Ordinance and was not self-created. e. Granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The proposed press box would be located on top of the home bleachers and would be over 700 feet from the nearest residential property. f. The variance would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g. The variance is the minimum necessary to eliminate the hardship. 3. A variance is approved for wall signage on all walls of the concession building, in accordance with the sign plan received by the City on August 18, 1999, based on the following findings: a. The shape of the facility creates a unique hardship, as distinguished from a mere inconvenience. The functional characteristics of the stadium make it necessary to have signage on both the stadium entrance and the rear of the building to direct stadium patrons to the appropriate window or entrance. b. The conditions relating to the hardship are not generally applicable to other properties in the P -I zoning district. Based on the needs of a 3,200 student high school, the stadium is unlike any other athletic facility in the City. The concession building serves multiple purposes and the additional signage is necessary to eliminate confusion for the stadium users. c. The request is not based exclusively upon a desire to increase value or income potential of the property. The additional signage would direct spectators to the appropriate gates for tickets, bleachers and concessions. d. The hardship is caused by the Zoning Ordinance and was not self-created. Resolution 99-348 (99052-2) Page 3 of 4 e. Granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The proposed signage would be directional in nature and would not be visible from the adjacent homes. f. The variances would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g. The variance is the minimum necessary to eliminate the hardship and provide clear directions to stadium patrons. 4. A sign variance is approved to allow an 18 -foot high, 200 -square foot scoreboard where one 40 -square foot scoreboard is permitted, based on the following findings: a. The physical surroundings of the property create a unique hardship, as distinguished from a mere inconvenience. Because of the size of the stadium, the applicant requires a larger scoreboard in order to make the scoreboard visible to all spectators. b. The conditions relating to the hardship are not generally applicable to other properties in the P -I zoning district. The student population at the high school requires a stadium that is substantially larger than any other athletic facility in the City. The size of the stadium creates the need for the larger scoreboard. The request is not based exclusively upon a desire to increase value or income potential of the property. The larger scoreboard would be visible to all spectators in the stadium bleachers. d. The hardship is caused by the Zoning Ordinance and was not self-created. Granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The proposed scoreboard would be on the north end of the football field and would not be visible from the adjacent homes. f. The variances would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g. The variance is the minimum necessary in order to install a scoreboard that is visible to all spectators in this 5,400 -seat stadium. 5. Sign permits are required for all signage. Resolution 99-348 (99052-2) Page 4 of 4 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 8. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21030.06 of the Zoning Ordinance.
