HomeMy WebLinkAboutCity Council Resolution 2015-256CITY OF PLYMOUTH RESOLUTION No. 2015-256 RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "THE PINES AT ELM CREEK" FOR PROPERTY LOCATED AT 6020, 6040, 6110, AND 6140 LAWNDALE LANE (2015059) WHEREAS, 0134 The Pines, LLC has requested approval of a final plat for 41 single-family lots on roughly 28 acres located at 6020, 6040, 6110, and 6140 Lawndale Lane; and WHEREAS, the property is presently legally described as: That part of the North Half of the Northwest Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota described as follows: Beginning at the northwest corner of said Section 5, Township 118, Range 22; thence on an assumed bearing of South 00 degrees 57 minutes 50 seconds West, along the west line of said North Half of the Northwest Quarter of Section 5, a distance of 1359.88 feet to the southwest corner of said North Half of the Northwest Quarter of Section 5; thence North 89 degrees 21 minutes 02 seconds East, along the south line of said North Half of the Northwest Quarter of Section 5 a distance of 1333.00 feet; thence North 00 degrees 57 minutes 50 seconds East, parallel with said west line of the North Half of the Northwest Quarter, a distance of 704.00 feet; thence South 89 degrees 21 minutes 02 seconds West, parallel with said south line of the North Half of the Northwest Quarter, a distance of 301.50 feet; thence North 22 degrees 59 minutes 00 seconds East to a point on the north line of said North Half of the Northwest Quarter 1299.00 feet east of said northwest corner of Section 5; thence South 89 degrees 26 minutes 34 seconds West, along said north line of said North Half of the Northwest Quarter a distance of 1299.00 feet to the point of beginning; EXCEPTING therefrom the East Half of the following described parcel: Beginning at said southwest corner of the North Half of the Northwest Quarter; thence North 89 degrees 21 minutes 02 seconds East, along the south line of said North Half of the Northwest Quarter of Section 5 a distance of 1333.00 feet; thence North 00 degrees 57 minutes 50 seconds East, parallel with said west line of the North Half of the Northwest Quarter, a distance of 704.00 feet; thence South 89 degrees 21 minutes 02 seconds West, parallel with said south line of the North Half of the Northwest Quarter, a distance of 1333.00 feet to said west line of the North Half of the Northwest Quarter of Section 5; thence South 00 degrees 57 minutes 50 seconds West a distance of 704.00 feet to the point of beginning. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. Resolution 2015-256 File 2015059 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by OP4 The Pines, LLC for a final plat for The Pines at Elm Creek; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for The Pines at Elm Creek is hereby approved in accordance with the plans received by the city on July 8, 2015, except as may be amended by this resolution. 2. Prior to commencement of grading operations, the developer shall install and request inspection of tree preservation fencing and silt fencing. 3. Prior to recording the final plat, the developer shall: a) Execute the development contract and provide the related financial guarantees and fees. b) Receive city approval of final construction plans. c) Pay the required park dedication fee. d) Demonstrate that adequate access is provided to the pond. e) Revise the plan to relocate the sidewalk for the area south of 61" Avenue to the inner circle of lots. f) Remove all existing structures from the site. Demolition permits are required for removal of existing structures over 120 square feet in size. g) Provide a separate trail easement document, in recordable form, for a ten -foot wide trail easement along the west side of those properties that abut Lawndale Lane, and along the south side of those properties that abut County Road 47. The trail easement document shall be recorded with the final plat. h) Provide a separate temporary turnaround easement document, in recordable form, for the temporary turn -around at the east end of 591h Place North until it is extended to the north (Jewel Lane) with the second phase of the development. The temporary turn -around easement document shall be recorded with the final plat. 4. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 5. The Developer shall notify potential property owners and homebuyers about the future roadway extension of Jewel Lane within the plat. 6. Lots located entirely within the shoreland overlay district for Elm Creek shall comply with the maximum impervious surface coverage regulations specified in section 21665 of the zoning ordinance. Resolution 2015-256 File 2015059 Page 3 7. Standard Conditions: a. No building permits shall be issued until the final plat is recorded, the streets (including curb and gutter installation) needed for access to lots where permits are requested are paved with the first lift of asphalt, and the sewer and water service utilities are tested and approved by the city engineer/designee. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. Relocate hydrants to locations as approved by the Fire Inspector, and to avoid conflict with the relocated sidewalk. d. Any signage shall require separate permits and shall comply with the city's sign regulations. e. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. f. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. g. Except for the landscaped median island at the site entrance, no trees shall be planted in the boulevard. h. Compliance with the city's tree preservation regulations. i. Removal of all hazardous trees at the owner's expense. j. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
