HomeMy WebLinkAboutCity Council Resolution 1999-315CITY OF PLYMOUTH RESOLUTION 99-315 APPROVING INTERIM USE PERMIT FOR LAWRENCE BEGIN FOR PROPERTY LOCATED ROUGHLY 600 FEET EAST OF FERNBROOK LANE AT 43RD AVENUE (99041) WHEREAS, Lawrence Begin has requested an interim use permit for property located roughly 600 feet east of Fernbrook Lane at 43rd Avenue, legally described as follows: The West Half of the Southeast Quarter of the Northwest Quarter of the Northwest Quarter, except the south 336 feet thereof, Section 15, Township 118, Range 24, Hennepin County, Minnesota, according to the government survey thereof. WHEREAS, this interim use permit for land reclamation would allow the deposit of approximately 4,000 additional cubic yards of fill on the site; and WHEREAS, the Planning Commission has reviewed said request and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lawrence Begin for an interim use permit to deposit approximately 4,000 additional cubic yards of fill at property located roughly 600 feet east of Fernbrook Lane at 43rd Avenue, subject to the following conditions: 1. This Interim Use Permit is for land reclamation to permit the deposit of roughly 4,000 additional cubic yards of fill on the site, in accordance with the application received by the City on April 30, 1999, except as amended by this resolution. 2. Prior to issuance of the required grading permit, the petitioner shall remove the fill that was placed off the site. 3. Prior to issuance of the required grading permit, the petitioner shall install a second silt fence at the top of the slope along the east boundary of the site, to ensure that no more fill is pushed over the bank. 4. Compliance with the City Engineer's Memo. Resolution 99-315 (99041) Page 2 5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 6. The permit does not allow for a sanitary landfill. 7. Hours of the reclamation operation shall be limited to between 7:00 a.m. to 7:00 p.m. Mondays through Saturdays. 8. The applicant shall schedule an on-site inspection to review erosion control measures prior to commencement of the filling operation. 9. Compliance with all applicable City Codes regarding erosion control. 10. The applicant's engineer shall verify that the approved grading plan was followed upon project completion. 11. The tree preservation boundary shall be demarcated with a silt fence until vegetation is established. 12. All disturbed and reclaimed areas shall be seeded with a mixture of grasses natural to the State of Minnesota. 13. The reclamation operation, including filling, grading, and seeding, shall be completed by August 3, 2000. Adopted by the City Council this 3rd day of August, 1999.
