HomeMy WebLinkAboutCity Council Resolution 1999-311CITY OF PLYMOUTH RESOLUTION 99-311 APPROVING FINDINGS OF FACT FOR REZONING FOR MOEN LEUER CONSTRUCTION FOR PROPERTY LOCATED NORTH OF MEDINA ROAD, WEST OF CO. RD. 24, AND SOUTH OF HIGHWAY 55. (9820 1) WHEREAS, Moen Leuer Construction has requested reclassification of the zoning from FRD (Future Restrict Development) to PUD (Planned Unit Development) for a 28.3 -acre property legally described as follows: The south 344.3 feet of the southwest quarter of the southwest quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota; ALSO, Outlot D, Cornerstone Commons Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommended approval; and, WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to PUD; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does support the request by Moen Leuer Construction for reclassification of the zoning from FRD (Future Restricted Development) to PUD (Planned Unit Development) for a 28.3 -acre property located north of Medina Road, west of Co. Rd. 24, and south of Highway 55, based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and plans. The subject property is guided PI (Planned Industrial). The PUD would allow uses consistent with the I-1 zoning district, which is the City's most restrictive industrial classification. Therefore, the uses allowed in the PUD would be consistent with the City's Land Use Guide Plan. 2. There is adequate infrastructure to support the proposed development and rezoning of the parcel. Res99-311 98201 Page 2 3. Adequate buffers as required by the Zoning Ordinance are provided between the proposed industrial use and the adjacent residential properties. The buffers consist of increased setbacks, a change in grade, a noise wall and landscaping. 4. The proposed PUD allows for the efficient use of land resulting in smaller networks of utilities and streets, thereby lowering development costs, long term maintenance expenses, and public investments. 5. The reduced internal setbacks and private drives would allow more convenience in site design and building location, which allows for a phased and orderly development.
