HomeMy WebLinkAboutCity Council Resolution 1999-310CITY OF PLYMOUTH RESOLUTION 99-310 APPROVING PLANNED UNIT DEVELOPMENT GENERAL PLAN AND PRELIMINARY PLAT FOR MOEN LEUER CONSTRUCTION FOR PROPERTY LOCATED NORTH OF MEDINA ROAD, SOUTH OF HIGHWAY 55, AND WEST OF CO. RD. 24 (98201) WHEREAS, Moen Leuer Construction has requested approval of a Planned Unit Development General Plan and Preliminary Plat for a 384,000 -square foot office/ warehouse/light manufacturing development located on property legally described as: The south 344.3 feet of the southwest quarter of the southwest quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota; ALSO, Outlot D, Cornerstone Commons Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Moen Leuer Construction for a planned unit development general plan and preliminary plat, subject to the following conditions: 1. A planned unit development general plan for the construction of an approximately 384,000 -square foot office/warehouse/light manufacturing development is approved, subject to the approval of the rezoning and Wetland Mitigation Plan, and according to the plans received by the City on May 24, 1999 and the application received on November 24, 1998, except as amended by this resolution. 2. A Preliminary Plat is approved for the creation of four lots, in accordance with the plat and plans received by the City on May 24, 1999 and the application received on November 24, 1998, except as amended by this resolution. Resolution 99-310 (98201) Page 2 3. The Planned Unit Development General Plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. Minimum development standards are as indicated on the PUD General Plan. 5. Light standards shall be shielded, and shall not exceed 25 feet in height. 6. Prior to the issuance of building permits, the applicant shall revise the Grading Plan to add a 2 to 4 -foot high berm north of Building 8 to provide additional screening for the loading dock area. 7. The uses allowed in the PUD shall consist of the permitted and conditional uses allowed in the I -I (Light Industrial) zoning district, with the exception of commercial antennas; minor automobile repair; servicing of motor freight vehicles and heavy construction equipment; outside storage except as allowed by the PUD; and open or outdoor service, sale, and rental. 8. The height of the buildings may not exceed 29 feet. 9. The applicant shall provide an easement over the existing Plymouth Ponds development to allow the shared use of the Co. Rd. 24 access. 10. The buildings shall conform to the following general architectural standards: a) All building materials shall be of high quality and constructed of durable materials. Major exterior surfaces of all walls shall be stone, precast concrete, glass, stucco, decorative block, or similar materials. b) Building colors and materials shall be harmonious throughout the development. c) Trash and recycling storage areas shall be designed internal to the buildings, or screened in compliance with Zoning Ordinance requirements. There shall be no exterior trash enclosures on Building 5. 11. All signage for the development shall conform to the following standards: a) All signs shall conform to Section 21155.03 (Signs - General Regulations and Restrictions) of the Zoning Ordinance. b) Wall signs shall be located so as not to be directly visible from adjacent residential properties. c) Wall signs shall be prohibited on the south side of Building 5. Resolution 99-310 (98201) Page 3 d) All signs shall be designed and constructed in a uniform manner and, to the extent possible, as an integral part of the building's architecture. Uniform signage shall be used throughout the development. e) All wall signs shall consist of individual dimensional letters and logos. f) Tenant signage shall consist of business identification only. Corporate logos, emblems, display messages, and similar identifying devices are permitted provided they are confined within the sign band and do not occupy more than fifteen (15) percent of the sign area. g) Wall signs shall not exceed twenty-four (24) inches in height, and shall not cover more than five (5) percent of the wall area. h) Temporary signage shall comply with Zoning Ordinance requirements. i) A project identification sign consisting of the project name and address shall be permitted at the main entrance from Medina Road. The sign shall not exceed 12 feet in height. 12. Wetland buffer monuments shall be located adjacent to all wetlands in accordance with Section 21670.07 of the Plymouth Zoning Ordinance. 13. There shall be no outside storage in the development, except as allowed by the PUD. 14. Truck trailers may be stored for over 96 -hours in the area between Buildings 6 and 7, provided the trailers are not stored for over 14 days. The outside storage of trailers shall be prohibited in the remainder of the development. 15. The necessary cross access and parking agreements shall be recorded prior to issuance of building permits. 16. Include the final grading and landscaping for the areas south of Building 5 in the first phase of development. 17. Remove the parking from the main drive aisle to the west of Building 5. 18. The following conditions shall apply to Building 5: a) The use of the loading docks on Building 5 shall be prohibited from 10:00 p.m. to 6:-09 7:00 a.m. b) There shall be no storage of truck trailers behind Building 5. c) There shall be no staging of trucks behind Building 5. Trucks at the loading docks on Building 5 must turn off their engines when loading or unloading. Resolution 99-310 (98201) Page 4 d) The applicant shall post signs every 150 feet behind Building 5 stating that the staging of truck is prohibited, that trucks must turn off their engines when loading or unloading, and that the use of the loading docks shall be prohibited from 10:00 p.m. to 7:00 a.m.. The applicant shall submit a copy of the proposed sign for staff review and approval prior to issuance of a building permit for Building 5. 19. The applicant shall revise the building and site plans to turn the saw -tooth loading docks in the opposite direction on Building 5. The applicant shall post this area of the site "one-way" to ensure that truck traffic is from the east to the west. 20. The applicant shall construct a noise wall to the south of Building 5 to provide noise attenuation for any loading area not screened by an intervening building. The wall shall comply with the following conditions: a) The noise wall shall be constructed of wood and concrete and be painted to match the existing buildings. b) The final design of the wall will require review by the Planning Commission and approval by the City Council, with notification to the adjacent residential property owners within 750 feet of the site. A building permit shall not be issued for Building 5 until after the final design of the noise wall has received City Council approval. c) The design of the wall will be evaluated by a noise expert selected by the City to determine the height, length, materials, location and design of the wall. The applicant shall be responsible for the cost of the noise evaluation. d) The noise wall shall be designed so that impulse noise does not exceed 60 dBA more than two times per three consecutive hours, as measured at the property line of the noise generator adjacent to Medina Road. e) The noise wall shall be in place prior to issuance of a certificate of occupancy for Building 5. f) If necessary, the landscape plan shall be revised to accommodate the noise wall. Any changes to the landscape plan shall be submitted with the plans for the noise wall as required above. g) The length of the noise wall may be reduced by eliminating docks or reducing the size of the building, or a combination of the two, at the applicant's discretion. If at a later date the applicant wishes to add loading areas that were eliminated or construct the building area that may have been reduced, the length of the noise wall must be increased accordingly. Such an increase in the length of the noise wall would be allowed by administrative approval of a plan modification prior to issuance of a building permit for adding loading areas or a building addition. Standard Conditions: a) Compliance with the City Engineer's Memorandum. b) Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. c) Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. d) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e) Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. f) An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g) The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h) Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of recording the final plat. i) Compliance with regulations regarding handicapped parking spaces and access.
